| 5 | members; providing for duties; providing for a report | ||
| 6 | addressing the effects of the consolidation of all sworn | ||
| 7 | law enforcement functions in the state; providing for | ||
| 8 | future repeal; providing an effective date. | ||

| 10 | Be It Enacted by the Legislature of the State of Florida: | ||
| 11 | |||
| 12 | Section 1. This act shall be known by the popular name the | ||
| 13 | "Sunshine Security Act." | ||
| 14 | Section 2. Law Enforcement Agency Consolidation Task | ||
| 15 | Force.-- | ||
| 16 | (1)(a) There is created within the Executive Office of the | ||
| 17 | Governor the Law Enforcement Agency Consolidation Task Force. | ||
| 18 | Members of the task force shall be appointed no later than July | ||
| 19 | 10, 2004. The task force shall be composed of: | ||
| 20 | 1. Two representatives from private industry who have | ||
| 21 | expertise in corporate mergers, appointed by the Governor. | ||
| 22 | 2. The Attorney General or his or her designee. | ||
| 23 | 3. A member of the Senate, appointed by the President of | ||
| 24 | the Senate. | ||
| 25 | 4. A member of the House of Representatives, appointed by | ||
| 26 | the Speaker of the House of Representatives. | ||
| 27 | (b) The first meeting of the task force shall be held no | ||
| 28 | later than July 15, 2004, at which time the members shall select | ||
| 29 | by majority vote a chair from among its members. All other | ||
| 30 | recommendations of the task force shall be by majority vote of | ||
| 31 | those members in attendance. Three members of the task force | ||
| 32 | shall constitute a quorum. The task force is subject to the | ||
| 33 | requirements of chapter 119, Florida Statutes. All meetings of | ||
| 34 | the task force shall be in accordance with s. 286.011, Florida | ||
| 35 | Statutes, and the public in attendance at any meeting shall be | ||
| 36 | given the opportunity to participate. The Executive Office of | ||
| 37 | the Governor shall ensure that those persons who request | ||
| 38 | notification of the time and place of any meeting of the task | ||
| 39 | force, including its initial meeting, shall receive such notice | ||
| 40 | in a timely fashion. | ||
| 41 | (c) Members of the task force shall serve without | ||
| 42 | compensation. Members are entitled to reimbursement for per diem | ||
| 43 | and travel expenses in accordance with s. 112.061, Florida | ||
| 44 | Statutes. | ||
| 45 | (d) The Executive Office of the Governor shall provide | ||
| 46 | staff support for the task force within existing appropriations. | ||
| 47 | (2)(a) The task force shall meet for the purpose of | ||
| 48 | studying the effects of consolidating law enforcement functions | ||
| 49 | in state agencies and commissions under a unified command. The | ||
| 50 | task force shall submit a preliminary report of its findings and | ||
| 51 | recommendations to the Governor, the President of the Senate, | ||
| 52 | and the Speaker of the House of Representatives no later than 45 | ||
| 53 | days prior to the first day of the 2005 Regular Session of the | ||
| 54 | Legislature. The final report shall be filed with the Governor, | ||
| 55 | the President of the Senate, and the Speaker of the House of | ||
| 56 | Representatives no later than 30 days prior to the first day of | ||
| 57 | the 2005 Regular Session of the Legislature. | ||
| 58 | (b) The preliminary and final report shall: | ||
| 59 | 1. Identify all law enforcement functions and duties of | ||
| 60 | personnel positions that exist in each state agency or | ||
| 61 | commission. | ||
| 62 | 2. Identify all statutory provisions assigning law | ||
| 63 | enforcement duties to state agencies or commissions. | ||
| 64 | 3. Identify the options considered by the task force for | ||
| 65 | consolidation of state law enforcement functions, duties, and | ||
| 66 | personnel and identify costs for consolidation under each option | ||
| 67 | considered. | ||
| 68 | 4. Determine whether consolidation of any law enforcement | ||
| 69 | functions or law enforcement personnel, or both, would prove | ||
| 70 | more effective and efficient. Such determination shall include a | ||
| 71 | cost analysis and comparison, with supporting analysis. | ||
| 72 | 5. If the determination is made that consolidation is more | ||
| 73 | effective and efficient, recommend proposed legislation based | ||
| 74 | upon the recommended best option for consolidating any law | ||
| 75 | enforcement functions or law enforcement personnel, or both. | ||
| 76 | Such proposed legislation shall include, but not be limited to, | ||
| 77 | provision for any necessary restructuring of state agencies or | ||
| 78 | commissions as a result of the recommended reorganization. | ||
| 79 | (3)(a) Each state agency or commission shall fully | ||
| 80 | cooperate with the task force in the performance of its duties | ||
| 81 | under this section. | ||
| 82 | (b) Each state agency or commission that has been assigned | ||
| 83 | law enforcement functions or employs sworn law enforcement | ||
| 84 | personnel shall provide a report to the task force that | ||
| 85 | identifies each section of law upon which that agency or | ||
| 86 | commission relies for authority to perform law enforcement | ||
| 87 | functions and employ sworn law enforcement officers. This report | ||
| 88 | shall be submitted to the task force no later than August 1, | ||
| 89 | 2004. | ||
| 90 | (4) The task force shall sunset on July 1, 2005. | ||
| 91 | Section 3. This act shall take effect upon becoming a law. | ||
