| 1 | A bill to be entitled |
| 2 | An act relating to the offense of sexual battery on a |
| 3 | minor; providing for the statute of limitations for the |
| 4 | offense of sexual battery on a minor to be tolled during |
| 5 | the period of a victim's minority; specifying additional |
| 6 | circumstances under which the statute of limitations for a |
| 7 | civil or criminal action involving such offense is tolled; |
| 8 | providing an effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Statute of limitations tolled in cases of |
| 13 | sexual battery on a minor.--The applicable statute of |
| 14 | limitations for any civil or criminal action involving the |
| 15 | offense of sexual battery on a minor shall be tolled during the |
| 16 | period of the victim's minority and during any period in which |
| 17 | it is therapeutically determined that: |
| 18 | (1) The victim is unable to disclose information |
| 19 | concerning the incident at issue outside of a clinical setting; |
| 20 | (2) It is inadvisable for the victim to confront the |
| 21 | perpetrator; or |
| 22 | (3) It is medically inadvisable for the victim to disclose |
| 23 | publicly the incident at issue. |
| 24 | Section 2. This act shall take effect July 1, 2004. |
