12 | Be It Enacted by the Legislature of the State of Florida: |

14 | Section 1. Paragraph (g) is added to subsection (1) of |
15 | section 1001.43, Florida Statutes, to read: |
16 | 1001.43 Supplemental powers and duties of district school |
17 | board.--The district school board may exercise the following |
18 | supplemental powers and duties as authorized by this code or |
19 | State Board of Education rule. |
20 | (1) STUDENT MANAGEMENT.--The district school board may |
21 | adopt programs and policies to ensure the safety and welfare of |
22 | individuals, the student body, and school personnel, which |
23 | programs and policies may: |
24 | (g) Require random drug testing of student athletes for |
25 | use of performance enhancing drugs. To implement such random |
26 | drug testing, a district school board shall test 5 percent of |
27 | the student-athlete population of a school. |
28 | Section 2. Paragraph (e) is added to subsection (2) of |
29 | section 1006.20, Florida Statutes, to read: |
30 | 1006.20 Athletics in public K-12 schools.-- |
31 | (2) ADOPTION OF BYLAWS.-- |
32 | (e) The organization shall adopt bylaws specifying that in |
33 | order to qualify for membership in the organization, a school |
34 | must provide for random drug testing of its student athletes for |
35 | use of performance enhancing drugs. |
36 | Section 3. This act shall take effect July 1, 2004. |
