A bill to be entitled
2An act relating to athletics in the public schools;
3amending s. 1001.43, F.S.; authorizing district school
4board programs and policies to provide for random drug
5testing of student athletes; amending s. 1006.20, F.S.;
6requiring the bylaws of the Florida High School Athletic
7Association to specify that in order to qualify for
8membership in the organization, a school must provide for
9random drug testing for use of performance enhancing
10drugs; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Paragraph (g) is added to subsection (1) of
15section 1001.43, Florida Statutes, to read:
16     1001.43  Supplemental powers and duties of district school
17board.--The district school board may exercise the following
18supplemental powers and duties as authorized by this code or
19State Board of Education rule.
20     (1)  STUDENT MANAGEMENT.--The district school board may
21adopt programs and policies to ensure the safety and welfare of
22individuals, the student body, and school personnel, which
23programs and policies may:
24     (g)  Require random drug testing of student athletes for
25use of performance enhancing drugs. To implement such random
26drug testing, a district school board shall test 5 percent of
27the student-athlete population of a school.
28     Section 2.  Paragraph (e) is added to subsection (2) of
29section 1006.20, Florida Statutes, to read:
30     1006.20  Athletics in public K-12 schools.--
31     (2)  ADOPTION OF BYLAWS.--
32     (e)  The organization shall adopt bylaws specifying that in
33order to qualify for membership in the organization, a school
34must provide for random drug testing of its student athletes for
35use of performance enhancing drugs.
36     Section 3.  This act shall take effect July 1, 2004.
