11 | Planning and Community Right-to-Know Act is required to |
12 | pay an annual reporting fee; providing an effective date. |

14 | Be It Enacted by the Legislature of the State of Florida: |

16 | Section 1. Subsection (3) of section 252.85, Florida |
17 | Statutes, is amended to read: |
18 | 252.85 Fees.-- |
19 | (3) Any owner or operator of a facility that is required |
20 | to submit a report or filing under s. 313 of EPCRA shall pay an |
21 | annual reporting fee not to exceed $150 for those s. 313 EPCRA |
22 | listed substances in effect on January 1, 2004 1998. The |
23 | department shall establish by rule the date by which the fee is |
24 | to be paid, as well as a formula or method of determining the |
25 | applicable fee under this subsection. |
26 | Section 2. This act shall take effect July 1, 2004. |
