| 8 | Right-to-Know Act; amending s. 252.85, F.S.; revising a |
| 9 | specification with respect to substances for which an |
| 10 | owner or operator of a facility under the Emergency |
| 11 | Planning and Community Right-to-Know Act is required to |
| 12 | pay an annual reporting fee; providing an effective date. |

| 14 | Be It Enacted by the Legislature of the State of Florida: |
| 15 |
|
| 16 | Section 1. Subsection (3) of section 252.85, Florida |
| 17 | Statutes, is amended to read: |
| 18 | 252.85 Fees.-- |
| 19 | (3) Any owner or operator of a facility that is required |
| 20 | to submit a report or filing under s. 313 of EPCRA shall pay an |
| 21 | annual reporting fee not to exceed $150 for those s. 313 EPCRA |
| 22 | listed substances in effect on January 1, 2004 1998. The |
| 23 | department shall establish by rule the date by which the fee is |
| 24 | to be paid, as well as a formula or method of determining the |
| 25 | applicable fee under this subsection. |
| 26 | Section 2. This act shall take effect July 1, 2004. |
