12 | Be It Enacted by the Legislature of the State of Florida: |
13 |

14 | Section 1. Section 383.04, Florida Statutes, is amended to |
15 | read: |
16 | 383.04 Prophylactic required for eyes of infants.--Every |
17 | physician, midwife, or other person in attendance at the birth |
18 | of a child in the state is required to instill or have instilled |
19 | into the eyes of the baby within 1 hour after birth an effective |
20 | prophylactic recommended by the Committee on Infectious Diseases |
21 | of the American Academy of Pediatrics for the prevention of |
22 | neonatal ophthalmia. In addition, every baby born in a hospital |
23 | in the state shall receive, prior to being discharged from the |
24 | hospital, an eye examination using an ophthalmoscope and |
25 | dilation of the pupils for detection of pediatric congenital and |
26 | ocular abnormalities and developmental abnormalities. The |
27 | provisions relating to the examination using an ophthalmoscope |
28 | are not subject to the provisions of s. 383.07. This section |
29 | does not apply to cases where the parents file with the |
30 | physician, midwife, or other person in attendance at the birth |
31 | of a child written objections on account of religious beliefs |
32 | contrary to the use of drugs. In such case the physician, |
33 | midwife, or other person in attendance shall maintain a record |
34 | that such measures were or were not employed and attach thereto |
35 | any written objection. |
36 | Section 2. Section 383.07, Florida Statutes, is reenacted |
37 | to read: |
38 | 383.07 Penalty for violation.--Any person who fails to |
39 | comply with the provisions of ss. 383.04-383.06 shall be guilty |
40 | of a misdemeanor of the second degree, punishable as provided in |
41 | s. 775.083. |
42 | Section 3. Paragraph (a) of subsection (2) of section |
43 | 627.6416, Florida Statutes, is amended to read: |
44 | 627.6416 Coverage for child health supervision services.-- |
45 | (2) As used in this section, the term "child health |
46 | supervision services" means physician-delivered or physician- |
47 | supervised services that include, at a minimum, services |
48 | delivered at the intervals and scope stated in this section. |
49 | (a) Child health supervision services must include |
50 | periodic visits which shall include a history, a physical |
51 | examination, a developmental assessment and anticipatory |
52 | guidance, and appropriate immunizations and laboratory tests, |
53 | and eye examinations at birth, at 6 to 8 weeks of age, and at 6 |
54 | to 9 months of age, using an ophthalmoscope and dilation of the |
55 | pupils for detection of pediatric congenital and ocular |
56 | abnormalities and developmental abnormalities. Such services and |
57 | periodic visits shall be provided in accordance with prevailing |
58 | medical standards consistent with the Recommendations for |
59 | Preventive Pediatric Health Care of the American Academy of |
60 | Pediatrics. |
61 | Section 4. Paragraph (b) of subsection (30) of section |
62 | 641.31, Florida Statutes, is amended to read: |
63 | 641.31 Health maintenance contracts.-- |

65 | (b) As used in this subsection, the term "child health |
66 | supervision services" means physician-delivered or physician- |
67 | supervised services that include, at a minimum, services |
68 | delivered at the intervals and scope stated in this subsection. |
69 | 1. Child health supervision services must include periodic |
70 | visits which shall include a history, a physical examination, a |
71 | developmental assessment and anticipatory guidance, and |
72 | appropriate immunizations and laboratory tests, and eye |
73 | examinations at birth, at 6 to 8 weeks of age, and at 6 to 9 |

76 | abnormalities and developmental abnormalities. Such services and |
77 | periodic visits shall be provided in accordance with prevailing |

80 | Pediatrics. |
81 | 2. Minimum benefits may be limited to one visit payable to |
82 | one provider for all of the services provided at each visit |
83 | cited in this subsection. |
84 | Section 5. This act shall take effect July 1, 2004. |
