1 A bill to be entitled
2 An act relating to the disposition of forfeited
3 property; amending s. 932.7055, F.S.; limiting
4 the use of any forfeited vehicle retained by a
5 seizing agency to specified law-enforcement
6 purposes; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (1) of section 932.7055, Florida
11 Statutes, is amended to read:
12 932.7055 Disposition of liens and forfeited
13 property.--
14 (1) When a seizing agency obtains a final judgment
15 granting forfeiture of real property or personal property, it
16 may elect to:
17 (a) Retain the property for the agency's use;
18 (b) Sell the property at public auction or by sealed
19 bid to the highest bidder, except for real property which
20 should be sold in a commercially reasonable manner after
21 appraisal by listing on the market; or
22 (c) Salvage, trade, or transfer the property to any
23 public or nonprofit organization.

25 If a seizing agency retains a forfeited vehicle, the agency
26 may use the vehicle only for purposes of law enforcement,
27 including undercover operations and crime-prevention programs.
28 The vehicle may not be used for personal transportation that
29 is unrelated to these authorized purposes.
30 Section 2. This act shall take effect upon becoming a
31 law.
