7290.00703, F.S.; authorizing the City of South Daytona to
8apply to the Office of Tourism, Trade, and Economic
9Development to designate an enterprise zone within an area
10of the City of South Daytona; authorizing the Office of
11Tourism, Trade, and Economic Development to designate one
12enterprise zone in the City of South Daytona; providing
13requirements with respect thereto; amending s. 290.0065,
14F.S.; authorizing certain counties to apply to the Office
15of Tourism, Trade, and Economic Development to amend
16existing enterprise zone boundaries under specified
17conditions and in accordance with certain criteria;
18providing an effective date.

20Be It Enacted by the Legislature of the State of Florida:
21
22     Section 1.  Section 290.00703, Florida Statutes, is created
23to read:
24     290.00703  Enterprise zone designation for the City of
25South Daytona.--The City of South Daytona may apply to the
26Office of Tourism, Trade, and Economic Development for
27designation of one enterprise zone within the city. The
28application must be submitted by December 31, 2004, and must
29comply with the requirements of s. 290.0055. Notwithstanding the
30provisions of s. 290.0065 limiting the total number of
31enterprise zones designated and the number of enterprise zones
32within a population category, the Office of Tourism, Trade, and
33Economic Development may designate one enterprise zone under
34this section. The Office of Tourism, Trade, and Economic
35Development shall establish the initial effective date of the
36enterprise zone designated under this section.
37     Section 2.  Subsection (12) is added to section 290.0065,
38Florida Statutes, to read:
39     290.0065  State designation of enterprise zones.--
40     (12)  Before November 30, 2004, any county as defined in s.
41125.011 may apply to the Office of Tourism, Trade, and Economic
42Development to change the boundaries of an existing enterprise
43zone for the purpose of replacing an area of not more than 75
44acres within the enterprise zone as of January 1, 2004, with an
45area of the same number of acres outside the enterprise zone as
46of January 1, 2004. The replacement area must be contiguous to
47the existing enterprise zone and must be a part of a
48revitalization area that has been targeted for assistance by the
49county. The replacement area also must be contiguous to a zoo
50and the county must have previously completed a master plan for
51development of the area. The Office of Tourism, Trade, and
52Economic Development shall approve the amendment effective
53January 1, 2005, if the enterprise zone remains consistent with
54the criteria and conditions imposed by s. 290.0055 upon the
55establishment of enterprise zones, including the requirement
56that the area suffer from pervasive poverty, unemployment, and
57general distress.
58     Section 3.  This act shall take effect upon becoming law.
