1 A bill to be entitled
2 An act relating to the state's health and human
3 services agencies; providing legislative
4 findings with respect to the need to provide
5 nutritional, medical, and social services to
6 the elderly, children, families, individuals
7 with disabilities, and low-income individuals
8 due to the impact of hurricanes and a tropical
9 storm in this state during 2004; providing
10 appropriations to the Department of Elderly
11 Affairs, the Department of Children and Family
12 Services, and the Agency for Persons with
13 Disabilities; requiring that the Executive
14 Office of the Governor provide prior notice to
15 the Legislative Budget Commission of
16 allocations from lump-sum appropriations to
17 appropriation categories; providing an
18 effective date.

20 Be It Enacted by the Legislature of the State of Florida:

22 Section 1. The Legislature finds that immediate
23 assistance is needed to provide nutritional, medical, and
24 social services to the elderly, children, families,
25 individuals with disabilities, and low-income individuals and
26 to provide services within the communities in which they live
27 in order to address the impact of Hurricanes Charley, Frances,
28 Jeanne, and Ivan and Tropical Storm Bonnie, which struck the
29 state during 2004.
30 Section 2. The sum of $12 million from the Federal
31 Grants Trust Fund is appropriated in lump sum to the

1 Department of Elderly Affairs for the purpose of providing
2 support services relating to the 2004 hurricanes and tropical
3 storm to the elderly during the 2004-2005 fiscal year.
4 Section 3. The sum of $4,704,736 from the Social
5 Services Block Grant Trust Fund and the sum $4,500,000 from
6 the Alcohol, Drug Abuse, and Mental Health Trust Fund are
7 appropriated in lump sum to the Department of Children and
8 Family Services for the purpose of providing support services
9 relating to the 2004 hurricanes and tropical storm to children
10 and families during the 2004-2005 fiscal year.
11 Section 4. The sum of $1,313,429 from the Social
12 Services Block Grant Trust Fund is appropriated in lump sum to
13 the Agency for Persons with Disabilities for the purpose of
14 providing support services relating to the 2004 hurricanes and
15 tropical storm to the developmentally disabled during the
16 2004-2005 fiscal year.
17 Section 5. Notwithstanding the provisions of section
18 216.177, Florida Statutes, requiring a 14-day notice for
19 interim budget actions, and pursuant to section 216.351,
20 Florida Statutes, the Executive Office of the Governor shall
21 provide notice of the allocation of the lump-sum
22 appropriations authorized by this act into traditional
23 appropriation categories to the chair and vice chair of the
24 Legislative Budget Commission at least 3 working days prior to
25 the effective date of such allocation.
26 Section 6. This act shall take effect upon becoming a
27 law.

2 SENATE SUMMARY
3 Provides appropriations to the Department of Elderly
Affairs, the Department of Children and Family Services,
