1 A bill to be entitled
2 An act relating to emergency funding for
3 temporary jobs for displaced workers affected
4 by the 2004 hurricane season; requiring the
5 Agency for Workforce Innovation to report to
6 the Governor and the Legislature on the
7 expenditure of federal funds received for the
8 purpose of providing temporary jobs and
9 assisting in the restoration efforts following
10 the tropical storm and hurricanes in this
11 state; requiring monitoring by the agency and
12 regional workforce boards to ensure compliance
13 with federal law; providing an appropriation;
14 providing budget authority to the agency with
15 respect to the expenditure of federal funds;
16 requiring that the Executive Office of the
17 Governor provide prior notice to the
18 Legislative Budget Commission of allocations
19 from the lump-sum appropriation to
20 appropriation categories; providing an
21 effective date.

23 Be It Enacted by the Legislature of the State of Florida:

25 Section 1. Beginning January 1, 2005, the Agency for
26 Workforce Innovation shall provide quarterly reports on the
27 expenditure of federal funds received from the United States
28 Department of Labor under the Workforce Investment Act -
29 National Emergency Grant for the purpose of providing
30 additional temporary jobs for eligible dislocated workers to
31 assist in the clean-up and restoration efforts resulting from

1 Tropical Storm Bonnie and Hurricanes Charley, Frances, Ivan,
2 and Jeanne. The quarterly reports relating to the temporary
3 jobs program shall be submitted to the Executive Office of the
4 Governor, the President of the Senate, and the Speaker of the
5 House of Representatives until the grant expires or the funds
6 are no longer available for this program. The reports must
7 include the number of participants who are provided temporary
8 jobs, the types of services being provided by participants in
9 those temporary jobs, any significant implementation problems
10 that occurred during the reporting period, the total
11 expenditures to date, and the number of related monitoring
12 visits conducted by the Agency for Workforce Innovation and
13 the regional workforce boards. Monitoring shall be conducted
14 to ensure that the worksites and related activities are
15 consistent with the provisions of applicable federal statute
16 and regulations.
17 Section 2. (1) For the 2004-2005 fiscal year, the sum
18 of $21 million is hereby appropriated from the Employment
19 Security Administration Trust Fund to the Agency for Workforce
20 Innovation in a lump-sum appropriation category. Such budget
21 authority is provided for federal funds received from the
22 United States Department of Labor under the Workforce
23 Investment Act - National Emergency Grant to provide for
24 additional temporary jobs for eligible dislocated workers to
25 assist in the clean-up and restoration efforts resulting from
26 Tropical Storm Bonnie and Hurricanes Charley, Frances, Ivan,
27 and Jeanne. To the extent that the United States Department of
28 Labor modifies the grant, the agency is authorized to spend
29 the grant funds as permitted by the federal government.
30 (2) The appropriation authorized by this act is
31 nonrecurring and is intended to address needs caused by

3 Section 3. Notwithstanding the provisions of section
4 216.177, Florida Statutes, requiring a 14-day notice for
5 interim budget actions, and pursuant to section 216.351,
6 Florida Statutes, the Executive Office of the Governor shall
7 provide notice of the allocation of the lump-sum appropriation
8 authorized by this act into traditional appropriation
9 categories to the chair and vice chair of the Legislative
10 Budget Commission at least 3 working days prior to the
11 effective date of such allocation.
12 Section 4. This act shall take effect upon becoming a
13 law.

16 SENATE SUMMARY
17 Requires the Agency for Workforce Innovation to report to
the Governor and the Legislature on the expenditure of

efforts following the 2004 tropical storm and hurricanes.
