A bill to be entitled
2An act relating to the Hurricane Recovery Trust Fund of
32004; creating s. 215.5595, F.S.; creating the Hurricane
4Recovery Trust Fund of 2004 within the Department of
5Revenue; providing for source of moneys and purposes;
6providing for exemption from general revenue service
7charges; providing for annual carryforward of unused
8funds; providing for future review and termination or re-
9creation of the trust fund; providing a contingent
10effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Section 215.5595, Florida Statutes, is created
15to read:
16     215.5595  Hurricane Recovery Trust Fund of 2004.--
17     (1)  There is created the Hurricane Recovery Trust Fund of
182004 within the Department of Revenue. Funds shall be credited
19to the trust fund as provided in s. 215.5593, the Hurricane
20Recovery Assistance Program of 2004, to be used for the purposes
21set forth therein. The trust fund is exempt from the service
22charges imposed by s. 215.20.
23     (2)  Notwithstanding the provisions of s. 216.301 and
24pursuant to s. 216.351, any balance in the trust fund at the end
25of any fiscal year shall remain in the trust fund at the end of
26the year and shall be available for carrying out the purposes of
27the trust fund.
28     (3)  Pursuant to the provisions of s. 19(f)(2), Art. III of
29the State Constitution, the trust fund shall, unless terminated
30sooner, be terminated 4 years from the effective date of this
31act on the same day of the year as the day of the effective date
32of this act. Prior to its scheduled termination, the trust fund
33shall be reviewed as provided in s. 215.3206.
34     Section 2.  This act shall take effect upon becoming a law,
35if House Bill 33A or similar legislation is adopted in the same
36legislative session or an extension thereof and becomes law.
