1	A bill to be entitled
2	An act relating to the Hurricane Recovery Trust Fund of
3	2004; creating s. 215.5595, F.S.; creating the Hurricane
4	Recovery Trust Fund of 2004 within the Department of
5	Revenue; providing for source of moneys and purposes;
6	providing for exemption from general revenue service
7	charges; providing for annual carryforward of unused
8	funds; providing for future review and termination or re-
9	creation of the trust fund; providing a contingent
10	effective date.

12	Be It Enacted by the Legislature of the State of Florida:

14	Section 1.  Section 215.5595, Florida Statutes, is created
15	to read:
16	215.5595  Hurricane Recovery Trust Fund of 2004.--
17	(1)  There is created the Hurricane Recovery Trust Fund of
18	2004 within the Department of Revenue. Funds shall be credited
19	to the trust fund as provided in s. 215.5593, the Hurricane
20	Recovery Assistance Program of 2004, to be used for the purposes
21	set forth therein. The trust fund is exempt from the service
22	charges imposed by s. 215.20.
23	(2)  Notwithstanding the provisions of s. 216.301 and
24	pursuant to s. 216.351, any balance in the trust fund at the end
25	of any fiscal year shall remain in the trust fund at the end of
26	the year and shall be available for carrying out the purposes of
27	the trust fund.
28	(3)  Pursuant to the provisions of s. 19(f)(2), Art. III of
29	the State Constitution, the trust fund shall, unless terminated
30	sooner, be terminated 4 years from the effective date of this
31	act on the same day of the year as the day of the effective date
32	of this act. Prior to its scheduled termination, the trust fund
33	shall be reviewed as provided in s. 215.3206.
34	Section 2.  This act shall take effect upon becoming a law,
35	if House Bill 33A or similar legislation is adopted in the same
36	legislative session or an extension thereof and becomes law.
