3     Amendment (with directory and title amendments)
4     Remove line(s) 20 through 30, and insert:
5     (4)  The following children are not eligible to receive
6premium assistance for health benefits coverage under the
7Florida KidCare program, except under Medicaid if the child
8would have been eligible for Medicaid under s. 409.903 or s.
9409.904 as of June 1, 1997:
10     (a)  A child who is eligible for coverage under a state
11health benefit plan on the basis of a family member's employment
12with a public agency in the state.
13     (f)(g)  A child who is otherwise eligible for KidCare and
14who has a preexisting condition that prevents coverage under
15another insurance plan as described in paragraph (a) (b) which
16would have disqualified the child for KidCare if the child were
17able to enroll in the plan shall be eligible for KidCare
18coverage when enrollment is possible.
19     (8)  In determining the eligibility of a child, an assets
20test is not required. Each applicant shall provide written
21documentation during the application process and the
22redetermination process, including, but not limited to, the
23following:
24     (a)  Proof of family income, which must include a copy of
25the applicant's most recent supported by copies of any federal
26income tax return. In the absence of a federal income tax
27return, an applicant may submit for the prior year, any wages
28and earnings statements (pay stubs), (W-2 forms), or and any
29other appropriate documents document.
30     (9)  Subject to paragraph (4)(a)(b) and s. 624.91(3), the
31Florida KidCare program shall withhold benefits from an enrollee
32if the program obtains evidence that the enrollee is no longer
33eligible, submitted incorrect or fraudulent information in order
34to establish eligibility, or failed to provide verification of
35eligibility. The applicant or enrollee shall be notified that
36because of such evidence program benefits will be withheld
37unless the applicant or enrollee contacts a designated
38representative of the program by a specified date, which must be
39within 10 days after the date of notice, to discuss and resolve
40the matter. The program shall make every effort to resolve the
41matter within a timeframe that will not cause benefits to be
42withheld from an eligible enrollee.
43     Section 2.  Paragraph (d) of subsection (3) of section
44624.91, Florida Statutes, is amended to read:
45     624.91  The Florida Healthy Kids Corporation Act.--
46     (3)  ELIGIBILITY FOR STATE-FUNDED ASSISTANCE.--Only the
47following individuals are eligible for state-funded assistance
48in paying Florida Healthy Kids premiums:
49     (d)  Notwithstanding s. 409.814, state employee dependents
50who were enrolled in the Florida Healthy Kids program as of
51January 31, 2004. Such individuals shall remain eligible until
52January 1, 2005.

56     Section 1.  Paragraphs (b) through (f) of subsection (4) of
57section 409.814, Florida Statutes, are redesignated as
58paragraphs (a) through (e), respectively, and present paragraphs
59(a) and (g) of subsection (4), paragraph (a) of subsection (8),
60and subsection (9) of said section are amended to read:

71Healthy Kids Corporation Act by a date certain;
