11 The Committee on Health Care (Saunders) recommended the
12 following amendment:

15 On page 3, lines 7-23, delete those lines
16
17 and insert:
18 (3) Notwithstanding ss. 456.073 and 456.077, failure
19 by a licensee to complete the requisite number of hours of
20 continuing education within a license renewal biennium, or
21 within 3 months following the end of the license renewal
22 biennium if an extension was requested by the licensee, is
23 grounds for the issuance of a citation and imposition of a
24 fine, plus a requirement that at least the deficit hours be
25 completed within a time established by rule of each board, or
26 the department if there is no board. If the licensee issued
27 the citation disputes the matter alleged in the citation, the
28 procedures set forth in s. 456.073 must be followed. However,
29 if the licensee does not dispute the matter alleged in the
30 citation, the citation becomes a public final order but does
31 not constitute discipline. Each board, or the department if

1 there is no board, shall establish by rule a fine for each
2 hour of continuing education which was not completed within
3 the license renewal biennium, or any 3-month extension
4 requested by the licensee, not to exceed $500 for each hour
5 not completed. In addition to a fine, the board, or the
6 department if there is no board, may impose other conditions
7 on a licensee issued a citation under this subsection. A
8 licensee may not be issued a citation under this subsection
9 more than twice, and a third or subsequent offense of failure
10 to complete the requisite number of hours of continuing
11 education is subject to s. 456.073. A licensee who has been
12 issued a citation under this subsection may not be issued a
13 citation under s. 456.077 for failure to complete the
14 requisite number of hours of continuing education within a
15 license renewal biennium or the 3 months following the end of
16 the license renewal biennium if an extension was requested by
17 the licensee.
