38requiring the office to establish the initial effective
39date of the enterprise zone; requiring the Office of
40Program Policy Analysis and Government Accountability to
41conduct a study of rural enterprise zone issues; requiring
42a report to the Legislature; providing an effective date.

44Be It Enacted by the Legislature of the State of Florida:
45
46     Section 1.  Section 290.00710, Florida Statutes, is created
47to read:
48     290.00710  Enterprise zone designation for the City of
49Lakeland.--The City of Lakeland may apply to the Office of
50Tourism, Trade, and Economic Development for designation of one
51enterprise zone for an area within the City of Lakeland, which
52zone shall encompass an area up to 10 square miles. The
53application must be submitted by December 31, 2005, and must
54comply with the requirements of s. 290.0055. Notwithstanding the
55provisions of s. 290.0065 limiting the total number of
56enterprise zones designated and the number of enterprise zones
57within a population category, the Office of Tourism, Trade, and
58Economic Development may designate one enterprise zone under
59this section. The Office of Tourism, Trade, and Economic
60Development shall establish the initial effective date of the
61enterprise zone designated pursuant to this section.
62     Section 2.  Section 290.0073, Florida Statutes, is created
63to read:
64     290.0073  Enterprise zone designation for Indian River
65County, the City of Vero Beach, and the City of
66Sebastian.--Indian River County, the City of Vero Beach, and the
67City of Sebastian may jointly apply to the Office of Tourism,
68Trade, and Economic Development for designation of one
69enterprise zone encompassing an area not to exceed 10 square
70miles. The application must be submitted by December 31, 2005,
71and must comply with the requirements of s. 290.0055.
72Notwithstanding the provisions of s. 290.0065 limiting the total
73number of enterprise zones designated and the number of
74enterprise zones within a population category, the Office of
75Tourism, Trade, and Economic Development may designate one
76enterprise zone under this section. The Office of Tourism,
77Trade, and Economic Development shall establish the initial
78effective date of the enterprise zone designated pursuant to
79this section.
80     Section 3.  Section 290.0074, Florida Statutes, is created
81to read:
82     290.0074  Enterprise zone designation for Sumter
83County.--Sumter County may apply to the Office of Tourism,
84Trade, and Economic Development for designation of one
85enterprise zone encompassing an area not to exceed 10 square
86miles. The application must be submitted by December 31, 2005.
87Notwithstanding the provisions of s. 290.0065 limiting the total
88number of enterprise zones designated and the number of
89enterprise zones within a population category, the Office of

118designation of one enterprise zone encompassing an area within
119the county or within both the county and the municipality. The

122number of enterprise zones designated and the number of
123enterprise zones within a population category, the Office of
124Tourism, Trade, and Economic Development may designate one
125enterprise zone under this section. The Office of Tourism,

127effective date of the enterprise zone designated pursuant to

129     Section 6.  Section 290.0077, Florida Statutes, is created
130to read:
131     290.0077  Enterprise zone designation for Orange County and
132the municipality of Apopka.--Orange County and the municipality
133of Apopka may jointly apply to the Office of Tourism, Trade, and
134Economic Development for designation of one enterprise zone. The
135application must be submitted by December 31, 2005, and must
136comply with the requirements of s. 290.0055. Notwithstanding the
137provisions of s. 290.0065 limiting the total number of
138enterprise zones designated and the number of enterprise zones
139within a population category, the Office of Tourism, Trade, and
140Economic Development may designate one enterprise zone under
141this section. The Office of Tourism, Trade, and Economic
142Development shall establish the initial effective date of the
143enterprise zone designated pursuant to this section.
144     Section 7.  The Office of Program Policy Analysis and
145Government Accountability shall conduct an evaluation of the tax
146incentives available to rural enterprise zones and the
147effectiveness of rural enterprise zones in creating jobs. In
148particular, the evaluation must consider whether existing tax
149and other financial incentives available under the Enterprise
150Zone Act are appropriate for businesses located in rural
151enterprise zones and whether incentives such as the transfer of
152unused tax credits would enhance the effectiveness of rural
153enterprise zones. The evaluation shall include an estimation of
154the costs of new tax incentives. The evaluation shall also
155identify obstacles faced by rural enterprise zones and recommend
156possible solutions. The Office of Program Policy Analysis and
157Government Accountability shall conduct its evaluation and make
158a report containing its findings and recommendations to the
159Legislature by December 1, 2005.
160     Section 8.  This act shall take effect July 1, 2005.
