1 A bill to be entitled
2 An act relating to professions regulated by the
3 Department of Business and Professional
4 Regulation; amending s. 455.271, F.S.;
5 providing for the reinstatement of certain
6 voided licenses; providing requirements for
7 application and reinstatement of voided
8 licenses, including fees, continuing education,
9 and eligibility; providing an exemption;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (6) of section 455.271, Florida
15 Statutes, is amended to read:
16 455.271 Inactive and delinquent status.--
17 (6)(a) A delinquent status licensee must affirmatively
18 apply with a complete application, as defined by rule of the
19 board, or the department if when there is no board, for active
20 or inactive status during the licensure cycle in which a
21 licensee becomes delinquent. Failure by a delinquent status
22 licensee to become active or inactive before the expiration of
23 the current licensure cycle shall render the license void null
24 without any further action by the board or the department. Any
25 subsequent licensure shall be as a result of applying for and
26 meeting all requirements imposed on an applicant for new
27 licensure.
28 (b) Notwithstanding the provisions of the professional
29 practice acts administered by the department, the board, or
30 the department if there is no board, may, at its discretion,
31 reinstate the license of an individual whose license has

1 become void if the board or department, as applicable,
2 determine that the individual has made a good-faith effort to
3 comply with this section but has failed to comply because of
4 illness or unusual hardship. The individual must apply to the
5 board, or the department if there is no board, for
6 reinstatement in a manner prescribed by rules of the board or
7 the department, as applicable, and shall pay an applicable fee
8 in an amount determined by rule. The board, or the department
9 if there is no board, shall require that such individual meet
10 all continuing education requirements prescribed by law, pay
11 appropriate licensing fees, and otherwise be eligible for
12 renewal of licensure under this chapter.

14 This subsection does not apply to individuals subject to
15 regulation under chapter 473.
16 Section 2. This act shall take effect July 1, 2005.
