| 4 | Between lines 128 and 129, insert: |
| 5 | Section 3. Section 68.066, Florida Statutes, is created to |
| 6 | read: |
| 7 | 68.066 Actions based upon use of a creation that is not |
| 8 | protected under federal copyright law.-- |
| 9 | (1) Except as provided in subsection (2), no use of an |
| 10 | idea, procedure, process, system, method of operation, concept, |
| 11 | principle, discovery, thought, or other creation that is not a |
| 12 | work of authorship protected under federal copyright law may |
| 13 | give rise to a claim or cause of action, in law or in equity, |
| 14 | unless the parties to the claim or cause of action have executed |
| 15 | a writing sufficient to indicate that a contract has been made |
| 16 | between them governing such use. |
| 17 | (2) Nothing in subsection (1) shall affect or limit: |
| 18 | (a) Any cause of action based in copyright, trademark, |
| 19 | patent, or trade secret; or |
| 20 | (b) Any defense raised in connection with a cause of |
| 21 | action described in paragraph (a). |
