A bill to be entitled
6An act relating to child safety; requiring school boards
7to promulgate policies regarding release of children;
8providing a definition; requiring copies of the policies
9to be provided to the Department of Education; requiring
10nonpublic schools, private schools, and certain child care
11facilities to promulgate policies regarding release of
12children; requiring that the policies are available on the
13premises of the schools or child care facilities;
14providing an effective date.

16Be It Enacted by the Legislature of the State of Florida:
17
18     Section 1.  No later than July 1, 2006, the school board of
19each public school district must promulgate policies that will
20ensure that the students in that school district are not
21released from the schools to persons who are not authorized to
22retrieve them. These policies must include a requirement that
23the person attempting to retrieve the student present a picture
24identification to the school principal or his or her designee
25before the student is released to the person. As used in this
26section, the term "picture identification" means a valid state
27driver's license, a valid state identification card, or a valid
28United States military identification card. Copies of the
29policies must be provided to the Department of Education.
30     Section 2.  No later than July 1, 2006, each nonpublic
31school exempt from licensure under s. 402.3025, Florida
32Statutes, child care facility licensed under s. 402.305, Florida
33Statutes, family day care home licensed or registered under s.
34402.3131, Florida Statutes, private school as defined in s.
351002.01, Florida Statutes, and faith-based child care provider
36exempt from licensure under s. 402.316, Florida Statutes, must
37promulgate policies that will ensure that the children in that
38nonpublic school, child care facility, day care home, private
39school, or faith-based child care provider are not released to
40persons who are not authorized to retrieve them. These policies
41must include a requirement that the person attempting to
42retrieve the child present a picture identification to the
43appropriate school or child care official or his or her designee
44before the child is released to the person. As used in this
45section, the term "picture identification" means a valid state
46driver's license, a valid state identification card, or a valid
47United States military identification card. Copies of these
48policies must be maintained on the premises of each entity
49covered by this section and be readily available for inspection.
50     Section 3.  This act shall take effect July 1, 2005.
