10 | nonpublic schools, private schools, and certain child care |
11 | facilities to promulgate policies regarding release of |
12 | children; requiring that the policies are available on the |
13 | premises of the schools or child care facilities; |
14 | providing an effective date. |

16 | Be It Enacted by the Legislature of the State of Florida: |
17 |

18 | Section 1. No later than July 1, 2006, the school board of |
19 | each public school district must promulgate policies that will |
20 | ensure that the students in that school district are not |
21 | released from the schools to persons who are not authorized to |
22 | retrieve them. These policies must include a requirement that |
23 | the person attempting to retrieve the student present a picture |
24 | identification to the school principal or his or her designee |
25 | before the student is released to the person. As used in this |
26 | section, the term "picture identification" means a valid state |
27 | driver's license, a valid state identification card, or a valid |
28 | United States military identification card. Copies of the |
29 | policies must be provided to the Department of Education. |
30 | Section 2. No later than July 1, 2006, each nonpublic |
31 | school exempt from licensure under s. 402.3025, Florida |
32 | Statutes, child care facility licensed under s. 402.305, Florida |
33 | Statutes, family day care home licensed or registered under s. |
34 | 402.3131, Florida Statutes, private school as defined in s. |
35 | 1002.01, Florida Statutes, and faith-based child care provider |
36 | exempt from licensure under s. 402.316, Florida Statutes, must |
37 | promulgate policies that will ensure that the children in that |
38 | nonpublic school, child care facility, day care home, private |
39 | school, or faith-based child care provider are not released to |
40 | persons who are not authorized to retrieve them. These policies |
41 | must include a requirement that the person attempting to |
42 | retrieve the child present a picture identification to the |
43 | appropriate school or child care official or his or her designee |
44 | before the child is released to the person. As used in this |
45 | section, the term "picture identification" means a valid state |
46 | driver's license, a valid state identification card, or a valid |
47 | United States military identification card. Copies of these |
48 | policies must be maintained on the premises of each entity |
49 | covered by this section and be readily available for inspection. |
50 | Section 3. This act shall take effect July 1, 2005. |
