| 4 | Council/Committee Substitute | 
| 5 | Remove the entire bill and insert: | 
| 6 | A bill to be entitled | 
| 7 | An act relating to child safety; requiring school boards | 
| 8 | to promulgate policies regarding release of children; | 
| 9 | providing a definition; requiring copies of the policies | 
| 10 | to be provided to the Department of Education; requiring | 
| 11 | nonpublic schools, private schools, and certain child care | 
| 12 | facilities to promulgate policies regarding release of | 
| 13 | children; requiring that the policies are available on the | 
| 14 | premises of the schools or child care facilities; | 
| 15 | providing an effective date. | 
| 16 |

| 17 | Be It Enacted by the Legislature of the State of Florida: | 
| 18 | 
 | 
| 19 | Section 1.  No later than July 1, 2006, the school board of | 
| 20 | each public school district must promulgate policies that will | 
| 21 | ensure that the students in that school district are not | 
| 22 | released from the schools to persons who are not authorized to | 
| 23 | retrieve them. These policies must include a requirement that | 
| 24 | the person attempting to retrieve the student present a picture | 
| 25 | identification to the school principal or his or her designee | 
| 26 | before the student is released to the person. As used in this | 
| 27 | section, the term "picture identification" means a valid state | 
| 28 | driver's license, a valid state identification card, or a valid | 
| 29 | United States military identification card. Copies of the | 
| 30 | policies must be provided to the Department of Education. | 
| 31 | Section 2.  No later than July 1, 2006, each nonpublic | 
| 32 | school exempt from licensure under s. 402.3025, Florida | 
| 33 | Statutes, child care facility licensed under s. 402.305, Florida | 
| 34 | Statutes, family day care home licensed or registered under s. | 
| 35 | 402.313, Florida Statutes, large family child care home licensed | 
| 36 | under s. 402.3131, Florida Statutes, private school as defined | 
| 37 | in s. 1002.01, Florida Statutes, and faith-based child care | 
| 38 | provider exempt from licensure under s. 402.316, Florida | 
| 39 | Statutes, must promulgate policies that will ensure that the | 
| 40 | children in that nonpublic school, child care facility, day care | 
| 41 | home, private school, or faith-based child care provider are not | 
| 42 | released to persons who are not authorized to retrieve them. | 
| 43 | These policies must include a requirement that the person | 
| 44 | attempting to retrieve the child present a picture | 
| 45 | identification to the appropriate school or child care official | 
| 46 | or his or her designee before the child is released to the | 
| 47 | person. As used in this section, the term "picture | 
| 48 | identification" means a valid state driver's license, a valid | 
| 49 | state identification card, or a valid United States military | 
| 50 | identification card. Copies of these policies must be maintained | 
| 51 | on the premises of each entity covered by this section and be | 
| 52 | readily available for inspection. | 
| 53 | Section 3.  This act shall take effect July 1, 2005. |
