A bill to be entitled
7An act relating to child safety; requiring school boards
8to promulgate policies regarding release of children;
9providing a definition; requiring copies of the policies
10to be provided to the Department of Education; requiring
11nonpublic schools, private schools, and certain child care
12facilities to promulgate policies regarding release of
13children; requiring that the policies are available on the
14premises of the schools or child care facilities;
15providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:

19     Section 1.  No later than July 1, 2006, the school board of
20each public school district must promulgate policies that will
21ensure that the students in that school district are not
22released from the schools to persons who are not authorized to
23retrieve them. These policies must include a requirement that
24the person attempting to retrieve the student present a picture
25identification to the school principal or his or her designee
26before the student is released to the person. As used in this
27section, the term "picture identification" means a valid state
28driver's license, a valid state identification card, or a valid
29United States military identification card. Copies of the
30policies must be provided to the Department of Education.
31     Section 2.  No later than July 1, 2006, each nonpublic
32school exempt from licensure under s. 402.3025, Florida
33Statutes, child care facility licensed under s. 402.305, Florida
34Statutes, family day care home licensed or registered under s.
35402.313, Florida Statutes, large family child care home licensed
36under s. 402.3131, Florida Statutes, private school as defined
37in s. 1002.01, Florida Statutes, and faith-based child care
38provider exempt from licensure under s. 402.316, Florida
39Statutes, must promulgate policies that will ensure that the
40children in that nonpublic school, child care facility, day care
41home, private school, or faith-based child care provider are not
42released to persons who are not authorized to retrieve them.
43These policies must include a requirement that the person
44attempting to retrieve the child present a picture
45identification to the appropriate school or child care official
46or his or her designee before the child is released to the
47person. As used in this section, the term "picture
48identification" means a valid state driver's license, a valid
49state identification card, or a valid United States military
50identification card. Copies of these policies must be maintained
51on the premises of each entity covered by this section and be
52readily available for inspection.
53     Section 3.  This act shall take effect July 1, 2005.
