11supervised athletic training experience; removing an
12obsolete provision; amending s. 468.711, F.S.; removing a
13provision requiring continuing education in standard first
14aid; amending s. 468.717, F.S.; revising a ground for
15punishment relating to practicing without a license;
16providing penalties; amending s. 468.723, F.S.; removing
17an exemption provision relating to teacher apprentice
18trainers and teacher athletic trainers; amending s.
191012.46, F.S.; providing for the replacement of teacher
20athletic trainers by athletic trainers licensed pursuant
21to part XIII of ch. 468; deleting the classification of
22first responder in a school district's athletic injuries
23prevention and treatment program; requiring that an
24athletic trainer employed by a school district be licensed
25as an athletic trainer; deleting a requirement that such
26person possess certain certification as an educator;
27providing an effective date.

29Be It Enacted by the Legislature of the State of Florida:
30
31     Section 1.  Subsection (1) of section 468.707, Florida
32Statutes, is amended to read:
33     468.707  Licensure by examination; requirements.--
34     (1)  Any person desiring to be licensed as an athletic
35trainer shall apply to the department on a form approved by the
36department.
37     (a)  The department shall license each applicant who:
38     (a)1.  Has completed the application form and remitted the
39required fees.
40     (b)2.  Is at least 21 years of age.
41     (c)3.  Has obtained a baccalaureate degree from a college
42or university accredited by an accrediting agency recognized and
43approved by the United States Department of Education or the
44Commission on Recognition of Postsecondary Accreditation, or
45approved by the board.
46     (d)4.  Has completed an approved athletic training
47curriculum coursework from a college or university accredited by
48an accrediting agency recognized and approved by the United
49States Department of Education or the Commission on Recognition
50of Postsecondary Accreditation, or approved by the board, in
51each of the following areas, as provided by rule: health, human
52anatomy, kinesiology/biomechanics, human physiology, physiology
53of exercise, basic athletic training, and advanced athletic
54training.
55     (e)5.  Has current certification in standard first aid and
56cardiovascular pulmonary resuscitation from the American Red
57Cross or an equivalent certification as determined by the board.
58     6.  Has, within 2 of the preceding 5 years, attained a
59minimum of 800 hours of athletic training experience under the
60direct supervision of a licensed athletic trainer or an athletic
61trainer certified by the National Athletic Trainers' Association
62or a comparable national athletic standards organization.
63     (f)7.  Has passed an examination administered or approved
64by the board.
65     (b)  The department shall also license each applicant who:
66     1.  Has completed the application form and remitted the
67required fees no later than October 1, 1996.
68     2.  Is at least 21 years of age.
69     3.  Has current certification in standard first aid and
70cardiovascular pulmonary resuscitation from the American Red
71Cross or an equivalent certification as determined by the board.
72     4.a.  Has practiced athletic training for at least 3 of the
735 years preceding application; or
74     b.  Is currently certified by the National Athletic
75Trainers' Association or a comparable national athletic
76standards organization.
77     Section 2.  Subsection (2) of section 468.711, Florida
78Statutes, is amended to read:
79     468.711  Renewal of license; continuing education.--
80     (2)  The board may, by rule, prescribe continuing education
81requirements, not to exceed 24 hours biennially. The criteria
82for continuing education shall be approved by the board and
83shall include a current certificate in 4 hours in standard first
84aid and cardiovascular pulmonary resuscitation from the American
85Red Cross or equivalent training as determined by the board.
86     Section 3.  Subsection (1) of section 468.717, Florida
87Statutes, is amended to read:
88     468.717  Violations and penalties.--Each of the following
89acts constitutes a misdemeanor of the first degree, punishable
90as provided in s. 775.082 or s. 775.083:
91     (1)  Practicing athletic training for compensation without
92holding an active license under this part.
93     Section 4.  Section 468.723, Florida Statutes, is amended
94to read:
95     468.723  Exemptions.--Nothing in This part does not prevent
96or restrict shall be construed as preventing or restricting:
97     (1)  The professional practice of a licensee of the
98department who is acting within the scope of such practice.
99     (2)  An athletic training student A student athletic
100trainer acting under the direct supervision of a licensed
101athletic trainer.
102     (3)  A person employed as a teacher apprentice trainer I, a
103teacher apprentice trainer II, or a teacher athletic trainer
104under s. 1012.46.
105     (3)(4)  A person from administering standard first aid
106treatment to an athlete.
107     (4)(5)  A person licensed under chapter 548, provided such
108person is acting within the scope of such license.
109     (5)(6)  A person providing personal training instruction
110for exercise, aerobics, or weightlifting, if the person does not
111represent himself or herself as able to provide "athletic
112trainer" services and if any recognition or treatment of
113injuries is limited to the provision of first aid.
114     Section 5.  Section 1012.46, Florida Statutes, is amended
115to read:
116     1012.46  Athletic trainers.--
117     (1)  School districts may establish and implement an
118athletic injuries prevention and treatment program. Central to
119this program should be the employment and availability of
120persons trained in the prevention and treatment of physical
121injuries that which may occur during athletic activities. The
122program should reflect opportunities for progressive advancement
123and compensation in employment as provided in subsection (2) and
124meet certain other minimum standards developed by the Department
125of Education. The goal of the Legislature is to have school
126districts employ and have available a full-time teacher athletic
127trainer in each high school in the state.
128     (2)  To the extent practicable, a school district program
129should include the following employment classification and
130advancement scheme:
131     (a)  First responder.--To qualify as a first responder, a
132person must possess a professional, temporary, part-time,
133adjunct, or substitute certificate pursuant to s. 1012.56, be
134certified in cardiopulmonary resuscitation, first aid, and have
13515 semester hours in courses such as care and prevention of
136athletic injuries, anatomy, physiology, nutrition, counseling,
137and other similar courses approved by the Commissioner of
138Education. This person may only administer first aid and similar
139care.
140     (2)(b)  Teacher athletic trainer.--To qualify as an a
141teacher athletic trainer, a person must be licensed under part
142XIII of chapter 468 and may possess a professional, temporary,
143part-time, adjunct, or substitute certificate pursuant to s.
1441012.35, s. 1012.56 or s. 1012.57, and be licensed as required
145by part XIII of chapter 468.
146     Section 6.  This act shall take effect upon becoming a law.
