15 | punishment relating to practicing without a license; |
16 | providing penalties; amending s. 468.723, F.S.; removing |
17 | an exemption provision relating to teacher apprentice |
18 | trainers and teacher athletic trainers; amending s. |
19 | 1012.46, F.S.; providing for the replacement of teacher |
20 | athletic trainers by athletic trainers licensed pursuant |
21 | to part XIII of ch. 468; deleting the classification of |
22 | first responder in a school district's athletic injuries |
23 | prevention and treatment program; requiring that an |
24 | athletic trainer employed by a school district be licensed |
25 | as an athletic trainer; deleting a requirement that such |
26 | person possess certain certification as an educator; |
27 | providing an effective date. |

29 | Be It Enacted by the Legislature of the State of Florida: |
30 |
|
31 | Section 1. Subsection (1) of section 468.707, Florida |
32 | Statutes, is amended to read: |
33 | 468.707 Licensure by examination; requirements.-- |
34 | (1) Any person desiring to be licensed as an athletic |
35 | trainer shall apply to the department on a form approved by the |
36 | department. |
37 | (a) The department shall license each applicant who: |
38 | (a)1. Has completed the application form and remitted the |
39 | required fees. |
40 | (b)2. Is at least 21 years of age. |
41 | (c)3. Has obtained a baccalaureate degree from a college |
42 | or university accredited by an accrediting agency recognized and |
43 | approved by the United States Department of Education or the |
44 | Commission on Recognition of Postsecondary Accreditation, or |
45 | approved by the board. |
46 | (d)4. Has completed an approved athletic training |
47 | curriculum coursework from a college or university accredited by |
48 | an accrediting agency recognized and approved by the United |
49 | States Department of Education or the Commission on Recognition |
50 | of Postsecondary Accreditation, or approved by the board, in |
51 | each of the following areas, as provided by rule: health, human |
52 | anatomy, kinesiology/biomechanics, human physiology, physiology |
53 | of exercise, basic athletic training, and advanced athletic |
54 | training. |
55 | (e)5. Has current certification in standard first aid and |
56 | cardiovascular pulmonary resuscitation from the American Red |
57 | Cross or an equivalent certification as determined by the board. |
58 | 6. Has, within 2 of the preceding 5 years, attained a |
59 | minimum of 800 hours of athletic training experience under the |
60 | direct supervision of a licensed athletic trainer or an athletic |
61 | trainer certified by the National Athletic Trainers' Association |
62 | or a comparable national athletic standards organization. |
63 | (f)7. Has passed an examination administered or approved |
64 | by the board. |
65 | (b) The department shall also license each applicant who: |
66 | 1. Has completed the application form and remitted the |
67 | required fees no later than October 1, 1996. |
68 | 2. Is at least 21 years of age. |
69 | 3. Has current certification in standard first aid and |
70 | cardiovascular pulmonary resuscitation from the American Red |
71 | Cross or an equivalent certification as determined by the board. |
72 | 4.a. Has practiced athletic training for at least 3 of the |
73 | 5 years preceding application; or |
74 | b. Is currently certified by the National Athletic |
75 | Trainers' Association or a comparable national athletic |
76 | standards organization. |
77 | Section 2. Subsection (2) of section 468.711, Florida |
78 | Statutes, is amended to read: |
79 | 468.711 Renewal of license; continuing education.-- |
80 | (2) The board may, by rule, prescribe continuing education |
81 | requirements, not to exceed 24 hours biennially. The criteria |
82 | for continuing education shall be approved by the board and |
83 | shall include a current certificate in 4 hours in standard first |
84 | aid and cardiovascular pulmonary resuscitation from the American |
85 | Red Cross or equivalent training as determined by the board. |
86 | Section 3. Subsection (1) of section 468.717, Florida |
87 | Statutes, is amended to read: |
88 | 468.717 Violations and penalties.--Each of the following |
89 | acts constitutes a misdemeanor of the first degree, punishable |
90 | as provided in s. 775.082 or s. 775.083: |
91 | (1) Practicing athletic training for compensation without |
92 | holding an active license under this part. |
93 | Section 4. Section 468.723, Florida Statutes, is amended |
94 | to read: |
95 | 468.723 Exemptions.--Nothing in This part does not prevent |
96 | or restrict shall be construed as preventing or restricting: |
97 | (1) The professional practice of a licensee of the |
98 | department who is acting within the scope of such practice. |
99 | (2) An athletic training student A student athletic |
100 | trainer acting under the direct supervision of a licensed |
101 | athletic trainer. |
102 | (3) A person employed as a teacher apprentice trainer I, a |
103 | teacher apprentice trainer II, or a teacher athletic trainer |
104 | under s. 1012.46. |
105 | (3)(4) A person from administering standard first aid |
106 | treatment to an athlete. |
107 | (4)(5) A person licensed under chapter 548, provided such |
108 | person is acting within the scope of such license. |
109 | (5)(6) A person providing personal training instruction |
110 | for exercise, aerobics, or weightlifting, if the person does not |
111 | represent himself or herself as able to provide "athletic |
112 | trainer" services and if any recognition or treatment of |
113 | injuries is limited to the provision of first aid. |
114 | Section 5. Section 1012.46, Florida Statutes, is amended |
115 | to read: |
116 | 1012.46 Athletic trainers.-- |
117 | (1) School districts may establish and implement an |
118 | athletic injuries prevention and treatment program. Central to |
119 | this program should be the employment and availability of |
120 | persons trained in the prevention and treatment of physical |
121 | injuries that which may occur during athletic activities. The |
122 | program should reflect opportunities for progressive advancement |
123 | and compensation in employment as provided in subsection (2) and |
124 | meet certain other minimum standards developed by the Department |
125 | of Education. The goal of the Legislature is to have school |
126 | districts employ and have available a full-time teacher athletic |
127 | trainer in each high school in the state. |
128 | (2) To the extent practicable, a school district program |
129 | should include the following employment classification and |
130 | advancement scheme: |
131 | (a) First responder.--To qualify as a first responder, a |
132 | person must possess a professional, temporary, part-time, |
133 | adjunct, or substitute certificate pursuant to s. 1012.56, be |
134 | certified in cardiopulmonary resuscitation, first aid, and have |
135 | 15 semester hours in courses such as care and prevention of |
136 | athletic injuries, anatomy, physiology, nutrition, counseling, |
137 | and other similar courses approved by the Commissioner of |
138 | Education. This person may only administer first aid and similar |
139 | care. |
140 | (2)(b) Teacher athletic trainer.--To qualify as an a |
141 | teacher athletic trainer, a person must be licensed under part |
142 | XIII of chapter 468 and may possess a professional, temporary, |
143 | part-time, adjunct, or substitute certificate pursuant to s. |
144 | 1012.35, s. 1012.56 or s. 1012.57, and be licensed as required |
145 | by part XIII of chapter 468. |
146 | Section 6. This act shall take effect upon becoming a law. |
