11 The Committee on Domestic Security (Hill) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 5, lines 13 through 29, delete those lines
16
17 and insert: security officer.--
18 (1) Any facility security officer as designated under
19 33 C.F.R. part 105 for each seaport identified in s. 311.09,
20 or any employee or agent holding a Class D or Class G license
21 and certification as a seaport security officer who is
22 designated by the facility security officer to maintain order
23 and provide security within the seaport, who has probable
24 cause to believe that a person is trespassing in a designated
25 restricted-access area of a seaport under s. 810.08 or s.
26 810.09, may take the person into custody and detain him or her
27 in a reasonable manner for a reasonable length of time pending
28 the arrival of a law enforcement officer. Taking a person into
29 custody or detention for trespassing does not render the
30 seaport security officer criminally or civilly liable for
31 false arrest, false imprisonment, or unlawful detention. If a

1 trespasser is taken into custody, a law enforcement officer
2 shall be called to the scene immediately after the person is
3 taken into custody.
4 (2) For the purpose of this section, a person who is
5 an employee of and is authorized to work at a seaport may not
6 be taken into custody and detained by a seaport security
7 officer for trespassing in an area designated as a
8 restricted-access area.

13 On page 1, line 30, after the semicolon,
14
15 insert:
16 providing that a person who is an employee of
17 and is authorized to work at a seaport may not
18 be taken into custody and detained for
19 trespassing in an area designated as a
20 restricted-access area;
