11  The Committee on Transportation and Economic Development
12  Appropriations (Dockery) recommended the following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 8, line 3, delete that line
16  
17  and insert:  immediately after the person is taken into
18  custody. For the purposes of this section, the term
19  "designated restricted access area" means an area where
20  signage, fencing, or other access-control measures designed to
21  prevent unauthorized access to that area are in place. During
22  a period of a high terrorist threat level, as defined by the
23  United States Department of Homeland Security or the
24  Department of Law Enforcement, or during a period of emergency
25  declared by the seaport security director of a particular port
26  due to events applicable to that particular port, the
27  management or controlling authority of the port may
28  temporarily designate any part or all of the port property as
29  a restricted access area. The duration of any such temporary
30  designation is limited to the period when the high terrorist
31  threat level or port emergency exists. This section does not

 1  limit the power of the managing or controlling authority of a
 2  seaport to designate any or all of the port property as a
 3  restricted access area as otherwise provided by law.
