8 | implement a program to offer immunizations against |
9 | influenza viruses to residents; requiring the Department |
10 | of Health to send such facilities reminder notices each |
11 | year; amending s. 1003.22, F.S.; requiring each district |
12 | school board and the governing authority of each private |
13 | school to provide information to parents concerning |
14 | meningococcal disease and its vaccine; requiring the |
15 | Department of Health to adopt rules specifying the age or |
16 | grade level of students for whom such information will be |
17 | provided; requiring each district school board and the |
18 | governing authority of each private school to determine |
19 | the means and method for the provision of information to |
20 | parents regarding meningococcal disease; providing an |
21 | effective date. |

23 | Be It Enacted by the Legislature of the State of Florida: |
24 |

25 | Section 1. Subsection (3) of section 381.005, Florida |
26 | Statutes, is renumbered as subsection (4) and a new subsection |
27 | (3) is added to said section to read: |
28 | 381.005 Primary and preventive health services.-- |
29 | (3) Between October 1, or earlier if the vaccination is |
30 | available, and February 1 of each year, subject to the |
31 | availability of an adequate supply of the necessary vaccine, |
32 | each assisted living facility licensed pursuant to chapter 400 |
33 | that has 11 or more residents shall implement a program to offer |
34 | immunizations against influenza viruses to all residents who are |
35 | age 65 or older, in accordance with the recommendations of the |
36 | Advisory Committee on Immunization Practices of the United |
37 | States Centers for Disease Control and Prevention and subject to |
38 | the clinical judgment of the responsible practitioner. By |
39 | September 1 of each year, the department shall send to each |
40 | assisted living facility covered by this section a reminder |
41 | notice relating to the facility's responsibilities under this |
42 | section. |
43 | Section 2. Subsection (10) of section 1003.22, Florida |
44 | Statutes, is amended to read: |
45 | 1003.22 School-entry health examinations; immunization |
46 | against communicable diseases; exemptions; duties of Department |
47 | of Health.-- |
48 | (10) Each district school board and the governing |
49 | authority of each private school shall: |
50 | (a) Refuse admittance to any child otherwise entitled to |
51 | admittance to kindergarten, or any other initial entrance into a |
52 | Florida public or private school, who is not in compliance with |
53 | the provisions of subsection (4). |
54 | (b) Temporarily exclude from attendance any student who is |
55 | not in compliance with the provisions of subsection (4). |
56 | (c) Provide detailed information to every student's parent |
57 | concerning the causes, symptoms, and transmission of |
58 | meningococcal disease; the risks associated with meningococcal |
59 | disease; and the availability, effectiveness, and known |
60 | contraindications of any required or recommended vaccine against |
61 | meningococcal disease, in accordance with the recommended ages |
62 | of students determined by the Department of Health to be |
63 | appropriate for the administration of such vaccine. The |
64 | Department of Health shall adopt rules that specify the age or |
65 | grade level of students for whom such information shall be |
66 | provided, consistent with the recommendations of the Advisory |
67 | Committee on Immunization Practices of the United States Centers |
68 | for Disease Control and Prevention concerning the appropriate |
69 | age for the administration of the vaccine, and shall make |
70 | available to school districts and the governing authorities of |
71 | each private school information concerning the causes, symptoms, |
72 | and transmission of meningococcal disease; the risks associated |
73 | with meningococcal disease; and the availability, effectiveness, |
74 | and known contraindications of any required or recommended |
75 | vaccine. Each district school board and the governing authority |
76 | of each private school shall determine the means and methods for |
77 | the provision of such information to students' parents. |
78 | Section 3. This act shall take effect July 1, 2005. |
