1 A bill to be entitled
2 An act relating to special risk retirement;
3 amending s. 121.0515, F.S.; providing that
4 emergency dispatchers and 911 operators
5 employed by a county or municipal law
6 enforcement agency may participate as part of
7 the Special Risk Administrative Support Class
8 and are eligible for the special risk normal
9 retirement date; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (a) of subsection (7) of section
14 121.0515, Florida Statutes, is amended to read:
15 121.0515 Special risk membership.--
16 (7) RETENTION OF SPECIAL RISK NORMAL RETIREMENT
17 DATE.--
18 (a) A special risk member who is moved or reassigned
19 to a nonspecial risk law enforcement, firefighting,
20 correctional, or emergency medical care administrative support
21 position with the same agency, or who is subsequently employed
22 in such a position with any law enforcement, firefighting,
23 correctional, or emergency medical care agency under the
24 Florida Retirement System, shall participate in the Special
25 Risk Administrative Support Class and shall earn credit for
26 such service at the same percentage rate as that earned by a
27 regular member. Notwithstanding the provisions of subsection
28 (4), service in such an administrative support position shall,
29 for purposes of s. 121.091, apply toward satisfaction of the
30 special risk normal retirement date, as defined in s.
31 121.021(29)(b), provided that, while in such position, the

1 member remains certified as a law enforcement officer,
2 firefighter, correctional officer, emergency medical
3 technician, or paramedic; remains subject to reassignment at
4 any time to a position qualifying for special risk membership;
5 and completes an aggregate of 6 or more years of service as a
6 designated special risk member prior to retirement.
7 Notwithstanding any other provision of law to the contrary,
8 emergency dispatchers and 911 operators who are employed full
9 time by a county or municipal law enforcement agency shall
10 participate in the Special Risk Administrative Support Class.
11 Such employees are eligible for the special risk normal
12 retirement date, as defined in s. 121.021(29)(b), and shall
13 earn credit for such service at the same percentage rate as
14 that earned by a regular member.
15 Section 2. This act shall take effect upon becoming a
16 law.

19 SENATE SUMMARY
20 Provides for emergency dispatchers and 911 operators who
are employed by a county or municipal law enforcement
21 agency under the Florida Retirement System to participate
in the Special Risk Administrative Support Class.
