14 On page 8, lines 8 and 9,

16 insert:
17 Section 4. Section 791.0125, Florida Statutes, is
18 created to read:
19 791.0125 Fire prevention and control of consumer
20 fireworks and sparklers.--To ensure uniform fire prevention
21 and safety standards for the use of consumer fireworks and
22 sparklers, except for federal law, the Legislature has
23 exclusive power to regulate the sale, use, safety standards,
24 and possession of fireworks in this state. A county,
25 municipality, or other unit of local government may not enact
26 any ordinance, rule, regulation, or other law after March 8,
27 2005, which prohibits or interferes with the safety standards
28 established by state law or the right to purchase, sell, use,
29 or possess consumer fireworks and sparklers in this state.
30 This preemption shall stand repealed on July 1, 2006, if the
31 Legislature enacts legislation to provide for the

1 comprehensive regulation of the sale, possession, storage,
2 display, and safe use of consumer fireworks.

8 And the title is amended as follows:
9 On page 2, line 1, after the second semicolon,
10
11 insert:
12 creating s. 791.0125, F.S.; providing that the
13 Legislature has exclusive power to regulate
14 consumer fireworks and sparklers; prohibiting a
15 county, municipality, or any other unit of
16 government from enacting a law after a certain
17 date which interferes with any state law
18 regulating consumer fireworks and sparklers;
19 providing for a repeal of this preemption under
20 certain circumstances;
