| 2 | An act relating to rehabilitation of contaminated |
| 3 | drycleaning facilities; amending s. 376.3078, F.S.; |
| 4 | providing that contaminated drycleaning facilities damaged |
| 5 | by accident at any time are eligible for site |
| 6 | rehabilitation, regardless of the date on which an |
| 7 | application for eligibility was filed; defining "accident" |
| 8 | for purposes of the act; providing an effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |

| 12 | Section 1. Paragraphs (i) through (r) of subsection (3) of |
| 13 | section 376.3078, Florida Statutes, are redesignated as |
| 14 | paragraphs (j) through (s), respectively, and a new paragraph |
| 15 | (i) is added to said subsection, to read: |
| 16 | 376.3078 Drycleaning facility restoration; funds; uses; |
| 17 | liability; recovery of expenditures.-- |
| 18 | (3) REHABILITATION LIABILITY.-- |
| 19 | (i) With regard to drycleaning facilities at which there |
| 20 | exists contamination by drycleaning solvents and which were |
| 21 | damaged by accident at any time, such facilities shall be |
| 22 | eligible under this subsection, regardless of whether an |
| 23 | application for eligibility was filed on or before December 31, |
| 24 | 1998. For the purposes of this subsection, "accident" means an |
| 25 | unplanned and unanticipated occurrence beyond the control of the |
| 26 | owner or operator of a drycleaning facility that resulted in |
| 27 | physical damage to the facility where the actions of responders |
| 28 | to such occurrence could reasonably be determined to have caused |
| 29 | or exacerbated contamination by drycleaning solvents at such |
| 30 | facility. |
| 31 | Section 2. This act shall take effect upon becoming a law. |
