1 A bill to be entitled
2 An act relating to infant eye care; amending s.
3 383.04, F.S.; requiring certain eye
4 examinations for all infants born in hospitals
5 in the state; exempting this requirement from
6 s. 383.07, F.S., relating to a penalty;
7 revising an exception to the certain
8 applicability requirements concerning infant
9 eye care; amending ss. 627.6416 and 641.31,
10 F.S.; providing that coverage for children
11 under health insurance policies and health
12 maintenance organization contracts must include
13 certain eye examinations for infants and
14 children; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Section 383.04, Florida Statutes, is
19 amended to read:
20 383.04 Prophylactic required for eyes of
21 infants.--Every physician, midwife, or other person in
22 attendance at the birth of a child in the state is required to
23 instill or have instilled into the eyes of the baby within 1
24 hour after birth an effective prophylactic recommended by the
25 Committee on Infectious Diseases of the American Academy of
26 Pediatrics for the prevention of neonatal ophthalmia. In
27 addition, each baby born in a hospital in the state must,
28 before being discharged from the hospital, receive an eye
29 examination using an opthalmoscope and dilation of the pupils
30 for detection of pediatric congenital and ocular
31 abnormalities; however, this requirement is not subject to s.

1 383.07. This section does not apply to cases where the parents
2 file with the physician, midwife, or other person in
3 attendance at the birth of a child written objections on
4 account of religious beliefs contrary to the use of drugs. In
5 such case the physician, midwife, or other person in
6 attendance shall maintain a record that such measures were or
7 were not employed and attach thereto any written objection.
8 Section 2. Paragraph (a) of subsection (2) of section
9 627.6416, Florida Statutes, is amended to read:
10 627.6416 Coverage for child health supervision
11 services.--
12 (2) As used in this section, the term "child health
13 supervision services" means physician-delivered or
14 physician-supervised services that include, at a minimum,
15 services delivered at the intervals and scope stated in this
16 section.
17 (a) Child health supervision services must include
18 periodic visits which shall include a history;, a physical
19 examination;, a developmental assessment and anticipatory
20 guidance;, and appropriate immunizations and laboratory tests;
21 and eye examinations at birth, at 6 to 8 weeks of age, and at
22 6 to 9 months of age, using an opthalmoscope and dilation of
23 the pupils for detection of pediatric congenital and ocular
24 abnormalities and developmental abnormalities. Such services
25 and periodic visits shall be provided in accordance with
26 prevailing medical standards consistent with the
27 Recommendations for Preventive Pediatric Health Care of the
28 American Academy of Pediatrics.
29 Section 3. Paragraph (b) of subsection (30) of section
30 641.31, Florida Statutes, is amended to read:

2 (b) As used in this subsection, the term "child health
3 supervision services" means physician-delivered or
4 physician-supervised services that include, at a minimum,
5 services delivered at the intervals and scope stated in this
6 subsection.

20 payable to one provider for all of the services provided at
21 each visit cited in this subsection.
22 Section 4. This act shall take effect July 1, 2005.

26 Requires certain eye examinations for all infants born in
hospitals in the state. Exempts this requirement from
27 certain penalty provisions. Revises an exception to the
requirements for infant eye care. Requires that coverage
28 for children under health insurance policies and health

29 examinations for infants and children.
