1 A bill to be entitled
2 An act relating to early learning; amending s.
3 1002.53, F.S.; requiring students to comply
4 with disciplinary policies; prohibiting certain
5 forms of discipline; amending s. 1002.65, F.S.;
6 requiring that, by a specified future date,
7 each school-year prekindergarten program
8 comprise at least a specified minimum number of
9 instructional hours; amending s. 1002.67, F.S.;
10 requiring that the department review and
11 approve the curriculum used by any provider in
12 implementing the Voluntary Prekindergarten
13 Education Program; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Subsection (7) is added to section 1002.53,
18 Florida Statutes, as created by section 1 of chapter 2004-484,
19 Laws of Florida, to read:
20 1002.53 Voluntary Prekindergarten Education Program;
21 eligibility and enrollment.--
22 (7) Each parent enrolling his or her child in the
23 Voluntary Prekindergarten Education Program must agree to
24 comply with the disciplinary policy of the private
25 prekindergarten provider or district school board, as
26 applicable. Upon enrollment of the child, the private
27 prekindergarten provider or public school, as applicable, must
28 provide the child's parent with a copy of the provider's or
29 school district's disciplinary policy, as applicable. Each
30 provider's or school's disciplinary policy must not subject a
31 child to discipline that:

1 (a) Is severe, humiliating, or frightening;
2 (b) Is associated with food, rest, or toileting; or
3 (c) Includes spanking or any other form of physical
4 punishment.
5 Section 2. Paragraph (a) of subsection (2) of section
6 1002.65, Florida Statutes, as created by section 1 of chapter
7 2004-484, Laws of Florida, is amended to read:
8 1002.65 Professional credentials of prekindergarten
9 instructors; aspirational goals; legislative intent.--
10 (2) To improve these educational outcomes, the
11 Legislature intends that all prekindergarten instructors will
12 continue to improve their skills and preparation through
13 education and training, so that the following aspirational
14 goals will be achieved:
15 (a) By the 2010-2011 school year:
16 1. Each prekindergarten class will have at least one
17 prekindergarten instructor who holds an associate's or higher
18 degree in the field of early childhood education or child
19 development; and
20 2. For each prekindergarten class composed of 11 or
21 more students, in addition to a prekindergarten instructor who
22 meets the requirements of subparagraph 1., the class will have
23 at least one prekindergarten instructor who meets the
24 requirements of s. 1002.55(3)(c); and.
25 3. Each school-year prekindergarten program delivered
26 by a private prekindergarten provider under s. 1002.55 or a
27 public school under s. 1002.63 will comprise at least 1,080
28 instructional hours.
29 Section 3. Paragraphs (a) and (c) of subsection (2) of
30 section 1002.67, Florida Statutes, as created by section 1 of
31 chapter 2004-484, Laws of Florida, are amended to read:

1 1002.67 Performance standards; curricula and
2 accountability.--
3 (2)(a) Each private prekindergarten provider and
4 public school may select or design the curriculum that the
5 provider or school uses to implement the Voluntary
6 Prekindergarten Education Program, which curriculum must be
7 reviewed and approved by the department except as otherwise
8 required for a provider or school that is placed on probation
9 under paragraph (3)(c).
10 (c) The department shall review and approve curricula
11 for use by private prekindergarten providers and public
12 schools that are placed on probation under paragraph (3)(c).
13 The department shall maintain a list of the curricula approved
14 under this paragraph (a). Each approved curriculum must meet
15 the requirements of paragraph (b).
16 Section 4. This act shall take effect upon becoming a
17 law.

20 SENATE SUMMARY
21 Requires that students enrolled in the Voluntary
Prekindergarten Education Program comply with
22 disciplinary policies. Prohibits certain forms of
discipline. Requires that, by the 2010-2011 school year,
23 each school-year prekindergarten program comprise at
least 1,080 instructional hours. Requires that the
24 department review and approve the curriculum used by any
provider, not just the curricula used by providers who
25 are on probation, in implementing the Voluntary
Prekindergarten Education Program.
