1 A bill to be entitled
2 An act relating to construction practices;
3 providing legislative findings and intent;
4 requiring the Florida Building Commission to
5 review construction practices and building
6 inspections in this state and to make
7 recommendations for the improvement of those
8 practices and inspections; providing procedures
9 for the review; requiring the commission to
10 report to the Governor and the Legislature;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Florida Building Commission review of
16 construction practices and inspections.--
17 (1) LEGISLATIVE FINDINGS AND INTENT.--The Legislature
18 finds that, due to the rapidly increasing rate of construction
19 which has occurred in the first few years of the 21st century,
20 the possibility exists for an increase in the prevalence of
21 construction flaws and for a decrease in the quality of
22 building and home inspections. The intent of the Legislature
23 is that the review initiated under this act will produce
24 findings that will increase the quality of construction and
25 optimize the effectiveness of home inspections, while
26 promoting the safety, accountability, and affordability of
27 construction in this state.
28 (2) REVIEW PROCEDURES.--Beginning July 1, 2005, the
29 Florida Building Commission shall conduct a review of current
30 construction practices in this state to formulate
31 recommendations concerning how to improve the quality of

1 construction in the state and how to maximize the
2 effectiveness of the building inspections and home inspections
3 associated with such construction. The commission shall
4 conduct or contract for research that supports this purpose
5 and shall conduct hearings and any other activities that the
6 commission considers essential in fulfilling this purpose.
7 (3) REPORT.--By January 15, 2006, the Florida Building
8 Commission shall submit a report of its findings to the
9 Governor, the President of the Senate, and the Speaker of the
10 House of Representatives. The report must include
11 recommendations for proposed legislation that the commission
12 considers appropriate and necessary.
13 Section 2. This act shall take effect July 1, 2005.
