6An act relating to physical education in the public
7schools; amending s. 1003.455, F.S.; requiring each school
8district to submit to the Department of Education a copy
9of the wellness policy required by federal law; requiring
10the department to provide public electronic access to
11school district policies; encouraging public input;
12specifying content of staff development for physical
13education instructors; encouraging each district school
14board to evaluate its physical education program and
15policy and review certain practices by a specified date;
16providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:
19
20     Section 1.  Subsections (4), (5), and (6) are added to
21section 1003.455, Florida Statutes, to read:
22     1003.455  Physical education; assessment.--
23     (4)  By December 1, 2005, each school district shall submit
24to the Department of Education a copy of the wellness policy
25required by the Child Nutrition and WIC Reauthorization Act of
262004. The department shall provide for public electronic access
27to the school district policies so they may be reviewed and
28shared. School districts are encouraged to regularly solicit
29public input regarding their policies on school nutritional
30offerings and physical activity/fitness offerings.
31     (5)  Staff development for physical education instructors
32must include content related to an integrated curriculum that
33supports classroom learning, particularly in the areas of
34reading and mathematics, fitness-based instruction, and
35connections between movement and learning.
36     (6)  By January 1, 2006, each district school board is
37encouraged to:
38     (a)  Evaluate the level of participation of students in the
39district school board's physical education program in order to
40determine whether the district school board's policy reflects
41the local community's expectations and needs.
42     (b)  Ensure that certified physical education teachers are
43hired to teach physical education.
44     (c)  Review and determine whether the district school
45board's professional development opportunities include best
46practices for fitness-related instruction, strategies that
47support classroom learning, connections between movement and
48learning, and strategies for integrating academic subject
49matter, particularly in reading, mathematics, and physical
50education.
51     (d)  Review the practice of providing physical fitness
52assessments at each grade level in order to provide valid
53information to students and parents for improving the quality of
54physical education programs and to determine whether its
55physical education program is meeting the needs of the community
56and parents.
57     (e)  Review the research and best practices regarding how
58planned physical movement can foster enhanced learning in
59academic subjects.
60     (f)  Review the district school board's adopted physical
61education policy in order to ensure that the policy meets the
62intent and spirit of the law, applicable rules, and the Sunshine
63State Standards.
64     Section 2.  This act shall take effect July 1, 2005.
