4     Between line(s) 197 and 198, insert:
5     Section 5.  Subsection (2) of section 627.638, Florida
6Statutes, is amended to read:
7     627.638  Direct payment for hospital, medical services.--
8     (2)  Whenever, in any health insurance claim form, an
9insured specifically authorizes payment of benefits directly to
10any recognized hospital, or physician, or dentist, the insurer
11shall make such payment to the designated provider of such
12services, unless otherwise provided in the insurance contract.
13The insurance contract may not prohibit, and claims forms must
14provide option for, the payment of benefits directly to a
15licensed hospital, physician, and dentist for care provided
16pursuant to s. 395.1041. The insurer may require written
17attestation of assignment of benefits. Payment to the provider
18from the insurer shall be no more than the amount that the
19insurer would otherwise have paid without the assignment.

27hospitals and identify hospitals unable to comply with the
28Florida Building Code or located in flood-prone areas;
29providing for membership, reimbursement, and duties of the
30study commission; requiring the Department of Community
31Affairs to provide staff for the study commission;
32requiring the commission to submit a report and
33recommendations to the Governor and the Legislature;
34creating a health insurance plan study group; specifying
35membership; requiring the Agency for Health Care
36Administration and the Office of Insurance Regulation to
37provide staff support; requiring the study group to
38investigate certain issues relating to health insurance
39plans; requiring the group to meet and submit
40recommendations to the Governor and the Legislature;
41directing the Office of Program Policy Analysis and
42Government Accountability to conduct a study to evaluate
43whether the State of Florida should join the Nurse
44Licensure Compact and to submit a report to the
45Legislature; providing that a licensee that failed to
46renew its ambulatory surgical center license may meet the
47requirements of the Florida Building Code under certain
48specified circumstances; amending s. 627.638, F.S.;
49proscribing insurance contracts from prohibiting payment
50of benefits directly to licensed hospitals, physicians,
51and dentists for certain care; providing a claims form
52requirement; authorizing insurers to make certain
53requirements; providing a limitation on certain payment to
54providers; providing an effective date.
