5 | Section 5. Subsection (2) of section 627.638, Florida |
6 | Statutes, is amended to read: |
7 | 627.638 Direct payment for hospital, medical services.-- |
8 | (2) Whenever, in any health insurance claim form, an |
9 | insured specifically authorizes payment of benefits directly to |
10 | any recognized hospital, or physician, or dentist, the insurer |
11 | shall make such payment to the designated provider of such |
12 | services, unless otherwise provided in the insurance contract. |
13 | The insurance contract may not prohibit, and claims forms must |
14 | provide option for, the payment of benefits directly to a |
15 | licensed hospital, physician, and dentist for care provided |
16 | pursuant to s. 395.1041. The insurer may require written |
17 | attestation of assignment of benefits. Payment to the provider |
18 | from the insurer shall be no more than the amount that the |
19 | insurer would otherwise have paid without the assignment. |

35 | membership; requiring the Agency for Health Care |
36 | Administration and the Office of Insurance Regulation to |
37 | provide staff support; requiring the study group to |
38 | investigate certain issues relating to health insurance |
39 | plans; requiring the group to meet and submit |
40 | recommendations to the Governor and the Legislature; |
41 | directing the Office of Program Policy Analysis and |
42 | Government Accountability to conduct a study to evaluate |
43 | whether the State of Florida should join the Nurse |
44 | Licensure Compact and to submit a report to the |
45 | Legislature; providing that a licensee that failed to |
46 | renew its ambulatory surgical center license may meet the |
47 | requirements of the Florida Building Code under certain |
48 | specified circumstances; amending s. 627.638, F.S.; |
49 | proscribing insurance contracts from prohibiting payment |
50 | of benefits directly to licensed hospitals, physicians, |
51 | and dentists for certain care; providing a claims form |
52 | requirement; authorizing insurers to make certain |
53 | requirements; providing a limitation on certain payment to |
54 | providers; providing an effective date. |
