| 5 | Section 15. Section 514.075, Florida Statutes, is amended |
| 6 | to read: |
| 7 | 514.075 Public pool service technician; |
| 8 | certification.--The department shall may require that a public |
| 9 | pool, as defined in s. 514.011, be serviced by a person |
| 10 | certified as a pool service technician. To be certified, an |
| 11 | individual must demonstrate knowledge of public pools which |
| 12 | includes, but is not limited to: pool cleaning; general pool |
| 13 | maintenance; source of the water supply; bacteriological, |
| 14 | chemical, and physical quality of water; and water purification, |
| 15 | testing, treatment, and disinfection procedures. The department |
| 16 | shall may, by rule, establish the requirement for the |
| 17 | certification course and course approval. The department shall |
| 18 | deem certified any individual who is certified by a course of |
| 19 | national recognition or any person licensed under s.489.105 |
| 20 | (3)(j), (k), or (l). This requirement does not apply to a |
| 21 | person, or the direct employee of a person, permitted as a |
| 22 | public pool operator under s. 514.031. The provisions of s. |
| 23 | 489.103 allowing employees to operate without a contractor's |
| 24 | license provided they are acting within the scope of the |
| 25 | contractor's license and with the knowledge and permission of |
| 26 | the contractor shall not apply to an employee servicing a public |
| 27 | pool unless such employee is certified as a public pool service |
| 28 | technician pursuant to this section. |
