A bill to be entitled
2An act relating to disposition of state land and
3facilities in the Florida Capitol Center; creating s.
4272.1231, F.S.; authorizing the Department of Management
5Services to determine that certain property in the Capitol
6Center is not needed for certain purposes; requiring the
7Division of State Lands of the Department of Environmental
8Protection to notify certain entities of such
9determination; authorizing such entities to apply for
10transfer of or enter into negotiations for such property;
11providing application requirements; authorizing the
12division to transfer such property or negotiate for the
13sale of such property at below appraised value under
14certain circumstances; requiring a joint agreement between
15certain entities prior to transfer or sale of such lands
16or facilities; providing for transfer approval by the
17Board of Trustees of the Internal Improvement Trust Fund;
18providing application; providing an effective date.

20Be It Enacted by the Legislature of the State of Florida:

22     Section 1.  Section 272.1231, Florida Statutes, is created
23to read:
24     272.1231  Disposition of public lands in the Florida
25Capitol Center Planning District.--
26     (1)  The Department of Management Services may determine
27that land and facilities located within the Florida Capitol
28Center Planning District are no longer needed for use by state
29government or any agency, board, bureau, or commission of state
30government. Upon such determination, the Division of State Lands
31of the Department of Environmental Protection shall notify, in
32writing, the Leon County Commission, the Tallahassee City
33Commission, the Leon County School Board, the Board of Trustees
34of Florida State University, the Board of Trustees of Florida
35Agricultural and Mechanical University, and the Board of
36Trustees of Tallahassee Community College and shall provide a
37period of not less than 120 days for such entities to evaluate
38the land and facilities for use by or ultimate sale to such
39entities as part of a publicly approved redevelopment plan. If
40any of such entities desires to enter into negotiations for such
41property, the entity may file an application with the division
42not later than 30 days after the expiration of the initial
43evaluation period. The application shall include, but not be
44limited to:
45     (a)  A description of the use the entity intends to make of
46the property.
47     (b)  Reasonable assurances that the entity can financially
48provide for the maintenance, upkeep, and use of the property.
49     (c)  Covenants and restrictions on the use of the property.

51The division shall develop criteria for evaluating any
52application.
53     (2)  The division may transfer land and facilities directly
54to the applying entity or, notwithstanding any other provision
55of law, may enter into negotiations that would provide for sale
56of the land and facilities to such entity at below appraised
57value. If no such entity timely applies for a transfer of or
58enters into negotiations for such property, the provisions of
59this section shall be satisfied and the land and facilities may
60be disposed of pursuant to the provisions of chapter 253. Final
61approval of any transfer or sale of such lands or facilities
62below appraised value shall be by the Board of Trustees of the
63Internal Improvement Trust Fund.
64     (3)  A sale or transfer of lands or facilities under this
65section shall only occur pursuant to a joint agreement between
66all of the entities enumerated in subsection (1).
67     (4)  The provisions of this section apply only to lands and
68facilities within the Florida Capitol Center Planning District
69and shall control the disposition of such lands and facilities
70to local government entities notwithstanding the provisions of
71chapter 253 or other provisions of law regulating the transfer
72of state lands and facilities.
73     Section 2.  This act shall take effect July 1, 2005.
