11 The Committee on Ways and Means (Margolis) recommended the
12 following amendment:

15 On page 23, between lines 14 and 15,

17 insert:
18 Section 2. An annual fee of $15 per slot machine is
19 hereby imposed upon each slot machine approved for use at any
20 eligible facility as defined in section 551.102, Florida
21 Statutes, which is within 2 miles of any neighboring
22 municipality. A "neighboring municipality" is defined as a
23 municipality that does not have an eligible facility but has 1
24 or more facility located within 2 miles of its municipal
25 borders. Revenue from the fees imposed by this section must be
26 used by the neighboring municipality for the purpose of
27 mitigating traffic and transportation problems that will be
28 caused by implementing Section 23, Article X of the State
29 Constitution and that will occur as a direct result of slot
30 machine operation. The annual fee must be remitted by each
31 eligible facility to the Department of Business and

1 Professional Regulation by February 1 of each year based on
2 the number of slot machines approved as of January 1 from the
3 facilities that are within 2 miles. The department shall
4 distribute the funds to any neighboring municipality
5 requesting mitigation funding. Any neighboring municipality
6 where an eligible facility is located is not entitled to
7 receive the aforementioned benefits if that municipality
8 currently has a financial agreement with any track for a
9 percentage of its benefits. If an eligible facility has an
10 agreement with any neighboring municipality that is within 2
11 miles of the facility and there are no other municipalities
12 within 2 miles of the eligible facility, the eligible facility
13 is exempt from paying the fee.

20 On page 1, line 27, after the second semicolon,

22 insert:

24 machines; providing for the use of the revenue
25 generated by the collection of the annual fee;
26 providing that the annual fee be remitted to
27 the department to be deposited in the Slot
28 Machine Administrative Trust Fund and
29 distributed by the department; providing that a
30 neighboring municipality is not entitled
31 receive fees remitted to the department under
