1 A bill to be entitled
2 An act relating to the regulation of massage
3 therapy; amending s. 480.034, F.S.; exempting
4 certain settings where massage therapy is
5 rendered from the licensure and inspection
6 requirements for massage establishments;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (5) is added to section 480.034,
12 Florida Statutes, to read:
13 480.034 Exemptions.--
14 (5) The licensure requirements of this chapter for
15 establishments do not apply to the practice of massage therapy
16 by a massage therapist:
17 (a) At the office of a medical physician licensed
18 under chapter 458, an osteopathic physician licensed under
19 chapter 459, a chiropractic physician licensed under chapter
20 460, an advanced registered nurse practitioner licensed under
21 part I of chapter 464, an acupuncturist licensed under chapter
22 457, a podiatric physician licensed under chapter 461, a
23 dentist licensed under chapter 466, or a physical therapist
24 licensed under chapter 486;
25 (b) At the residence or office of a massage
26 therapist's client, a sports event, a convention, or a trade
27 show, excluding colonic irrigation, as provided by rules
28 adopted by the board;
29 (c) At a facility operating under a license issued
30 under chapter 395 or chapter 400; or

1 (d) At a board-approved massage school, for
2 instructional purposes.
3 Section 2. This act shall take effect July 1, 2005.

6 SENATE SUMMARY
7 Extends the exemption from massage-establishment
licensure to the office of a Florida-licensed allopathic
8 physician, osteopathic physician, advanced registered
nurse practitioner, acupuncturist, chiropractic
9 physician, podiatric physician, dentist, or physical
therapist; the residence or office of a massage
10 therapist's client, a sports event, a convention, or a
trade show, excluding colonic irrigation, as provided by
11 rules of the Board of Massage Therapy; a facility
operating under a Florida-licensed hospital, nursing
12 home, or other facility licensed under ch. 400, F.S.; and
a board-approved massage school, for instructional
13 purposes.
