1 A bill to be entitled
2 An act relating to the regulation of massage
3 therapy; amending s. 480.034, F.S.; exempting
4 certain settings where massage therapy is
5 rendered from the licensure and inspection
6 requirements for massage establishments;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsections (5) and (6) are added to
12 section 480.034, Florida Statutes, to read:
13 480.034 Exemptions.--
14 (5) The licensure requirements of this chapter for
15 establishments do not apply to the practice of massage therapy
16 by a massage therapist:
17 (a) At the office of a medical physician licensed
18 under chapter 458, an osteopathic physician licensed under
19 chapter 459, a chiropractic physician licensed under chapter
20 460, an advanced registered nurse practitioner licensed under
21 part I of chapter 464, an acupuncturist licensed under chapter
22 457, a podiatric physician licensed under chapter 461, a
23 dentist licensed under chapter 466, or a physical therapist
24 licensed under chapter 486;
25 (b) At the office of a massage therapist licensed
26 under this chapter, if massage therapy is provided only to the
27 patients of the massage therapist, or at the residence or
28 office of a massage therapist's client, a sports event, a
29 convention, or a trade show, excluding colonic irrigation, as
30 provided by rules adopted by the board;

1 (c) At a facility operating under a license issued
2 under chapter 395 or chapter 400; or
3 (d) At a board-approved massage school, for
4 instructional purposes.
5 (6) A massage therapist who provides massage under
6 paragraph (5)(a) must obtain a license for an establishment if
7 massage is provided to a person other than a patient of the
8 licensed medical physician, osteopathic physician,
9 chiropractic physician, advanced registered nurse
10 practitioner, acupunturist, podiatric physician, dentist, or
11 physical therapist within the licensed health care
12 practitioner's office.
13 Section 2. This act shall take effect July 1, 2005.

15 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
16 Senate Bill 118

18 The Committee Substitute exempts the practice of massage
therapy by a massage therapist from the massage establishment
19 licensure requirements if massage is provided in the office of
certain Florida-licensed health care practitioners, and the
20 massage therapist who provides massage must obtain a license
for an establishment if massage is provided to a person other
21 than a patient of the licensed health care practitioner within
the licensed health care practitioner's office.

The Committee Substitute also exempts from the massage
23 establishment licensure requirements the practice of massage
therapy by a massage therapist if the massage is provided in
24 the office of a Florida-licensed massage therapist and is
provided only to the patients of the massage therapist.
