  1                      A bill to be entitled

  2         An act relating to building and facility

  3         designations; amending s. 267.062, F.S.;

  4         authorizing the boards of trustees of state

  5         universities to name campus buildings and

  6         facilities for living persons; requiring the

  7         Board of Governors to adopt uniform policies;

  8         reserving the right of the Legislature to name

  9         buildings or facilities; amending s. 1013.79,

10         F.S.; conforming a provision; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Subsection (1) of section 267.062, Florida

16  Statutes, is amended to read:

17         267.062  Naming of state buildings and other

18  facilities.--

19         (1)  Except as specifically provided by law, no state

20  building, road, bridge, park, recreational complex, or other

21  similar facility shall be named for any living person.

22  However, any such building or facility on the campus of a

23  state university may be named for any living person in

24  accordance with policies adopted by the university board of

25  trustees. The Board of Governors must adopt a uniform set of

26  policies to be used by each university board of trustees in

27  naming a building or facility for any living person. The

28  Legislature may enact legislation to name a building or

29  facility for any living person, which naming may not be

30  superseded by a university board of trustees.

 1         Section 2.  Subsection (11) of section 1013.79, Florida

 2  Statutes, is amended to read:

 3         1013.79  University Facility Enhancement Challenge

 4  Grant Program.--

 5         (11)  The surveys, architectural plans, facility, and

 6  equipment shall be the property of the State of Florida. A

 7  facility constructed pursuant to this section may be named in

 8  honor of a donor at the option of the university and the State

 9  Board of Education. No facility shall be named after a living

10  person without prior approval by the Legislature.

11         Section 3.  This act shall take effect July 1, 2005.

13          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
14                         Senate Bill 1186

15                                 

16  The Committee Substitute includes a requirement for the Board
    of Governors to adopt a uniform set of policies to be used by
17  each university board of trustees in naming a building or
    facility for a living person.  Language was also added which
18  expressly maintains the right of the Legislature to name a
    university building or facility and precludes a university
19  board of trustees from superseding such legislative action.
