1 A bill to be entitled
2 An act relating to prosperity campaigns;
3 creating s. 445.057, F.S.; establishing the
4 Prosperity Campaign Office to be housed in
5 Workforce Florida, Inc.; providing duties of
6 the office; providing for establishment of the
7 Florida Prosperity Campaign Council; providing
8 membership and responsibilities; providing for
9 meetings, per diem, and travel; requiring
10 development of financial literacy information
11 for use in high school courses in life
12 management skills and orientation programs at
13 community colleges and universities;
14 authorizing each prosperity campaign to connect
15 low-wage workers to economic benefits programs
16 and to offer additional services; providing for
17 reporting requirements; providing for future
18 repeal; amending s. 1003.43, F.S.; requiring
19 financial literacy instruction to be part of
20 courses in life management skills; providing an
21 effective date.

23 Be It Enacted by the Legislature of the State of Florida:
24
25 Section 1. Section 445.057, Florida Statutes, is
26 created to read:
27 445.057 Prosperity campaigns.--
28 (1) There is established the Prosperity Campaign
29 Office, which shall be administratively housed in Workforce
30 Florida, Inc. The office shall coordinate established
31 prosperity campaigns in the state, foster the establishment of

1 new campaigns in designated regional workforce areas and
2 assist in the development of their programs, coordinate with
3 the Internal Revenue Service in providing programs for
4 low-wage workers, and work closely with prosperity campaign
5 offices in other states.
6 (2) The office shall be headed by the Florida
7 Prosperity Campaign Council, which shall be composed of the
8 following members:
9 (a) Two individuals, each representing a different
10 prosperity campaign in the state, appointed by the Governor.
11 (b) One member of the Greater Miami Prosperity
12 Campaign.
13 (c) One member of the Senate appointed by the
14 President of the Senate.
15 (d) One member of the House of Representatives
16 appointed by the Speaker of the House of Representatives.
17 (e) The Chief Financial Officer or his or her
18 designee.
19 (f) One representative from the Florida Bankers
20 Association.
21 (g) One representative from the Florida Institute of
22 Certified Public Accountants.
23 (h) One representative from the Florida Credit Union
24 League.
25 (i) The Commissioner of Education or his or her
26 designee.
27 (j) One representative from the Florida League of
28 Cities.
29 (k) One representative from the Florida Association of
30 Counties.

1 (l) One representative from the Florida Association of
2 Realtors.
3 (m) One representative from United Way of Florida.
4 (n) One representative from Leadership Florida.
5 (o) One representative from the Florida Chamber of
6 Commerce.
7 (p) One representative from a nonprofit or
8 community-based low-wage worker organization.
9 (3) The members of the Prosperity Campaign Council
10 shall be appointed to 2-year terms starting on July 1, 2005.
11 Upon completion of the term, new members shall be appointed in
12 the same manner as the original appointments.
13 (4) The Prosperity Campaign Council shall meet each
14 quarter of the year or upon the call of the chairperson.
15 Annually, at the meeting in the first quarter, officers
16 consisting of a chairperson, vice chairperson, and secretary
17 shall be elected. Each officer shall serve until a successor
18 is elected. An officer may not serve more than two consecutive
19 terms in the same office.
20 (5) Members of the council shall serve without
21 compensation, but are entitled to reimbursement for per diem
22 and travel expenses in accordance with s. 112.061.
23 (6) The council's responsibilities shall include, but
24 are not limited to:
25 (a) Assisting in the development of prosperity
26 campaigns throughout the state.
27 (b) Coordinating with prosperity campaigns to assist
28 in the development of new programs.
29 (c) Developing implementation plans for new programs
30 using the best practices of existing and new prosperity
31 campaigns within and outside the state.

1 (d) Coordinating financial literacy classes or
2 programs within each prosperity campaign.
3 (e) Working with businesses and agencies to develop a
4 package of services for citizens participating in prosperity
5 campaigns.
6 (f) Working with the Department of Education in
7 developing financial literacy instruction to be part of the
8 course in life management skills pursuant to s. 1003.43. The
9 financial literacy information must focus on the importance of
10 financial management, savings, investments, credit scores, and
11 other relevant subjects. Community colleges and universities
12 are encouraged to use financial literacy information in
13 student orientation programs.
14 (g) Performing other activities deemed necessary by
15 the council or directed by Workforce Florida, Inc.
16 (7) Each prosperity campaign shall:
17 (a) Educate the public about available economic
18 benefits programs and the importance of wise financial
19 decisionmaking.
20 (b) Connect low-wage workers to economic benefits
21 programs, including, but not limited to, the Earned Income Tax
22 Credit and the Childcare Tax Credit.
23 (c) Offer free tax preparation services, economic
24 benefits screening, and other related services.
25 (d) Provide information to businesses to enable them
26 to distribute economic benefits information to current and new
27 employees.
28 (8) By June 30, 2006, and annually thereafter, the
29 Prosperity Campaign Council shall report to the Governor and
30 to the Legislature the effectiveness of the council, detailing
31 the progress made in establishing new prosperity campaigns,

1 including barriers to establishing new prosperity campaigns,
2 how the barriers were overcome, the partners involved and
3 their roles, and recommendations for the future.
4 (9) The Prosperity Campaign Council is abolished and
5 this section is repealed on July 1, 2009, unless reviewed and
6 saved from repeal through reenactment by the Legislature.
7 Section 2. Paragraph (i) of subsection (1) of section
8 1003.43, Florida Statutes, is amended to read:
9 1003.43 General requirements for high school
10 graduation.--
11 (1) Graduation requires successful completion of
12 either a minimum of 24 academic credits in grades 9 through 12
13 or an International Baccalaureate curriculum. The 24 credits
14 shall be distributed as follows:
15 (i) One-half credit in life management skills to
16 include instruction in financial literacy focused on the
17 importance of financial management, savings, investments,
18 credit scores, and other relevant subjects, consumer
19 education, positive emotional development, marriage and
20 relationship skill-based education, nutrition, parenting
21 skills, prevention of human immunodeficiency virus infection
22 and acquired immune deficiency syndrome and other sexually
23 transmissible diseases, benefits of sexual abstinence and
24 consequences of teenage pregnancy, information and instruction
25 on breast cancer detection and breast self-examination,
26 cardiopulmonary resuscitation, drug education, and the hazards
27 of smoking.

29 District school boards may award a maximum of one-half credit
30 in social studies and one-half elective credit for student
31 completion of nonpaid voluntary community or school service

1 work. Students choosing this option must complete a minimum
2 of 75 hours of service in order to earn the one-half credit in
3 either category of instruction. Credit may not be earned for
4 service provided as a result of court action. District school
5 boards that approve the award of credit for student volunteer
6 service shall develop guidelines regarding the award of the
7 credit, and school principals are responsible for approving
8 specific volunteer activities. A course designated in the
9 Course Code Directory as grade 9 through grade 12 that is
10 taken below the 9th grade may be used to satisfy high school
11 graduation requirements or Florida Academic Scholars award
12 requirements as specified in a district school board's student
13 progression plan. A student shall be granted credit toward
14 meeting the requirements of this subsection for equivalent
15 courses, as identified pursuant to s. 1007.271(6), taken
16 through dual enrollment.
17 Section 3. This act shall take effect July 1, 2005.

19 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
20 Senate Bill 1188

22 The committee substitute differs from SB 1188 in the following
manner:
23
- Changes the number of members on the council from 23 to
24 17;
25 - Provides term limits and meeting requirements for the
council;
26
- Requires the council to develop implementation plans for
27 new programs using best practices of existing and new
prosperity campaigns in and outside of the state;
28
- Requires the council to file an annual report with the
29 Governor and Legislature; and
30 - Repeals the council on July 1, 2009, unless reviewed and
reenacted by the Legislature.
