A bill to be entitled
2An act relating to poison control; amending ss. 395.1027,
3395.3025, and 456.057, F.S.; requiring a licensed
4facility, health care practitioner, or other records owner
5to release to regional poison control centers certain
6patient information upon request; providing an effective
7date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (3) of section 395.1027, Florida
12Statutes, is amended to read:
13     395.1027  Regional poison control centers.--
14     (3)  Upon request, a licensed facility or health care
15practitioner shall release to a regional poison control center
16any patient information that is relevant to the episode under
17evaluation for treatment or necessary for case management of
18poison cases and patient information necessary to comply with
19the data collection and reporting requirements of state or
20federal law.
21     Section 2.  Paragraph (m) is added to subsection (4) of
22section 395.3025, Florida Statutes, to read:
23     395.3025  Patient and personnel records; copies;
24examination.--
25     (4)  Patient records are confidential and must not be
26disclosed without the consent of the person to whom they
27pertain, but appropriate disclosure may be made without such
28consent to:
29     (m)  Regional poison control centers for patient
30information that is relevant to the episode under evaluation for
31treatment or case management of poison cases and patient
32information necessary to comply with the data collection and
33reporting requirements of state or federal law.
34     Section 3.  Subsection (20) is added to section 456.057,
35Florida Statutes, to read:
36     456.057  Ownership and control of patient records; report
37or copies of records to be furnished.--
38     (20)  Upon request, a records owner shall release to
39regional poison control centers patient information that is
40relevant to the episode under evaluation for treatment or case
41management of poison cases and patient information necessary to
42comply with the data collection and reporting requirements of
43state or federal law.
44     Section 4.  This act shall take effect July 1, 2005.
