4 Section 3. Subsection (5) is added to section 943.043,
5 Florida Statutes, to read:
6 943.043 Toll-free telephone number; Internet
7 notification; sexual predator and sexual offender
8 information.--
9 (5) In an effort to ensure that sexual predators and
10 sexual offenders who fail to respond to address-verification
11 attempts or who otherwise abscond from registration are
12 located in a timely manner, the department shall share
13 information with local law enforcement agencies. The
14 department shall use analytical resources to assist local law
15 enforcement agencies to determine the potential whereabouts of
16 any sexual predator or sexual offender who fails to respond to
17 address-verification attempts or who otherwise absconds from
18 registration. The department shall review and analyze all
19 available information concerning any such predator or offender
20 who fails to respond to address-verification attempts or who
21 otherwise absconds from registration and provide the
22 information to local law enforcement agencies in order to
23 assist the agencies in locating and apprehending the sexual
24 predator or sexual offender.
25 Section 4. Subsections (13) and (14) are added to
26 section 943.0435, Florida Statutes, to read:
27 943.0435 Sexual offenders required to register with
28 the department; penalty.--
29 (13) Any person who has reason to believe that a
30 sexual offender is not complying, or has not complied, with
31 the requirements of this section and who, with the intent to

1 assist the sexual offender in eluding a law enforcement agency
2 that is seeking to find the sexual offender to question the
3 sexual offender about, or to arrest the sexual offender for,
4 his or her noncompliance with the requirements of this
5 section:
6 1. Withholds information from, or does not notify, the
7 law enforcement agency about the sexual offender's
8 noncompliance with the requirements of this section, and, if
9 known, the whereabouts of the sexual offender;
10 2. Harbors, or attempts to harbor, or assists another
11 person in harboring or attempting to harbor, the sexual
12 offender; or
13 3. Conceals or attempts to conceal, or assists another
14 person in concealing or attempting to conceal, the sexual
15 offender; or
16 4. Provides information to the law enforcement agency
17 regarding the sexual offender that the person knows to be
18 false information,
19
20 commits a felony of the third degree, punishable as provided
21 in s. 775.082, s. 775.083, or s. 775.084.
22 (14)(a) A sexual offender must report in person each
23 year during the month of the sexual offender's birthday and
24 during the sixth month following the sexual offender's birth
25 month to the sheriff's office in the county in which he or she
26 resides or is otherwise located to reregister. The sheriff's
27 office may determine the appropriate times and days for
28 reporting by the sexual offender, which shall be consistent
29 with the reporting requirements of this paragraph.
30 Reregistration shall include any changes to the following
31 information:

1 1. Name; social security number; age; race; sex; date
2 of birth; height; weight; hair and eye color; address of any
3 permanent residence and address of any current temporary
4 residence, within the state or out of state, including a rural
5 route address and a post office box; date and place of any
6 employment; vehicle make, model, color, and license tag
7 number; fingerprints; and photograph. A post office box shall
8 not be provided in lieu of a physical residential address.
9 2. If the sexual offender is enrolled, employed, or
10 carrying on a vocation at an institution of higher education
11 in this state, the sexual offender shall also provide to the
12 department the name, address, and county of each institution,
13 including each campus attended, and the sexual offender's
14 enrollment or employment status.
15 3. If the sexual offender's place of residence is a
16 motor vehicle, trailer, mobile home, or manufactured home, as
17 defined in chapter 320, the sexual offender shall also provide
18 vehicle identification number; the license tag number; the
19 registration number; and a description, including color
20 scheme, of the motor vehicle, trailer, mobile home, or
21 manufactured home. If the sexual offender's place of residence
22 is a vessel, live-aboard vessel, or houseboat, as defined in
23 chapter 327, the sexual offender shall also provide the hull
24 identification number; the manufacturer's serial number; the
25 name of the vessel, live-aboard vessel, or houseboat; the
26 registration number; and a description, including color
27 scheme, of the vessel, live-aboard vessel or houseboat.
28 4. Any sexual offender who fails to report in person
29 as required at the sheriff's office, or who fails to respond
30 to any address verification correspondence from the department
31 within three weeks of the date of the correspondence, commits

1 a felony of the third degree, punishable as provided in s.
2 775.082, s. 775.083, or s. 775.084.
3 (b) The sheriff's office shall, within 2 working days,
4 electronically submit and update all information provided by
5 the sexual offender to the department in a manner prescribed
6 by the department. This procedure shall be implemented by
7 December 1, 2005.
8 Section 5. Section 943.04352, Florida Statutes, is
9 created to read:
10 943.04352 Search of registration information regarding
11 sexual predators and sexual offenders required when placement
12 on misdemeanor probation.--When the court places a defendant
13 on misdemeanor probation pursuant to ss. 948.01 and 948.15,
14 the public or private entity providing probation services must
15 conduct a search of the probationer's name or other
16 identifying information against the registration information
17 regarding sexual predators and sexual offenders maintained by
18 the Department of Law Enforcement under s. 943.043. The
19 probation services provider may conduct the search using the
20 Internet site maintained by the Department of Law Enforcement.
21 Section 6. Subsections (12) and (13) are added to
22 section 944.607, Florida Statutes, to read:
23 944.607 Notification to Department of Law Enforcement
24 of information on sexual offenders.--
25 (12) Any person who has reason to believe that a
26 sexual offender is not complying, or has not complied, with
27 the requirements of this section and who, with the intent to

22 (13)(a) A sexual offender must report in person each
23 year during the month of the sexual offender's birthday and
24 during the sixth month following the sexual offender's birth
25 month to the sheriff's office in the county in which he or she
26 resides or is otherwise located to reregister. The sheriff's

29 with the reporting requirements of this paragraph.

1 1.Name; social security number; age; race; sex; date of
2 birth; height; weight; hair and eye color; address of any
3 permanent residence and address of any current temporary
4 residence, within the state or out of state, including a rural
5 route address and a post office box; date and place of any
6 employment; vehicle make, model, color, and license tag
7 number; fingerprints; and photograph. A post office box shall
8 not be provided in lieu of a physical residential address.
9 2. If the sexual offender is enrolled, employed, or
10 carrying on a vocation at an institution of higher education
11 in this state, the sexual offender shall also provide to the
12 department the name, address, and county of each institution,
13 including each campus attended, and the sexual offender's
14 enrollment or employment status.
15 3. If the sexual offender's place of residence is a
16 motor vehicle, trailer, mobile home, or manufactured home, as
17 defined in chapter 320, the sexual offender shall also provide
18 vehicle identification number; the license tag number; the
19 registration number; and a description, including color
20 scheme, of the motor vehicle, trailer, mobile home, or
21 manufactured home. If the sexual offender's place of residence
22 is a vessel, live-aboard vessel, or houseboat, as defined in
23 chapter 327, the sexual offender shall also provide the hull
24 identification number; the manufacturer's serial number; the
25 name of the vessel, live-aboard vessel, or houseboat; the
26 registration number; and a description, including color
27 scheme, of the vessel, live-aboard vessel, or houseboat.
28 4. Any sexual offender who fails to report in person
29 as required at the sheriff's office, or who fails to respond
30 to any address verification correspondence from the department
31 within three weeks of the date of the correspondence, commits

1 a felony of the third degree, punishable as provided in s.
2 775.082, s. 775.083, and s. 775.084.
3 (b) The sheriff's office shall, within 2 working days,
4 electronically submit and update all information provided by
5 the sexual offender to the Florida Department of Law
6 Enforcement in a manner prescribed by the Florida Department
7 of Law Enforcement. This procedure shall be implemented by
8 December 1, 2005.
