17 and insert:
18 948.061 Identifying, assessing, and monitoring
19 high-risk sex offenders on community supervision; providing
20 cumulative criminal and supervision histories on the
21 Internet.--
22 (1) By December 1, 2005, the department shall develop
23 a graduated risk assessment that identifies, assesses, and
24 closely monitors a high-risk sex offender who is placed on
25 probation or in community control and who:
26 (a) Has previously been placed on probation or in
27 community control and has a history of committing multiple
28 violations of community supervision in this state or in any
29 other jurisdiction or have previously been incarcerated in
30 this state or in any other jurisdiction; and
31 (b) Has experienced more than one of the following

1 risk factors that could potentially make the offender more
2 likely to pose a danger to others:
3 1. Previous conviction for domestic violence;
4 2. History of substance abuse;
5 3. Unemployment or substantial financial difficulties;
6 4. Previous conviction for violence or sex acts
7 against children, particularly involving strangers; or
8 5. Any other risk factor identified by the department.
9 (2) To facilitate the information available to the
10 court at first appearance hearings and at all subsequent
11 hearings for these high-risk sex offenders, the department
12 shall, no later than March 1, 2006, post on FDLE's Criminal
13 Justice Intranet a cumulative chronology of the sex offender's
14 prior terms of state probation and community control,
15 including all substantive or technical violations of state
16 probation or community control. The sheriff's office in the
17 county where the arrested person is booked shall insure that
18 state and national criminal history information and all
19 criminal justice information available in the Florida Crime
20 Information Center and the National Crime Information Center,
21 is provided to the court at the time of the first appearance.
22 The courts shall assist the department's dissemination of
23 critical information by creating and maintaining an automated
24 system to provide the information as specified in this
25 subsection and by providing the necessary technology in the
26 courtroom to deliver the information.
27 (3) In monitoring the location of high-risk sex
