A bill to be entitled
2An act relating to Hillsborough County; authorizing the
3Division of Alcoholic Beverages and Tobacco of the Florida
4Department of Business and Professional Regulation to
5issue an alcoholic beverage license to the Arts Council of
6Hillsborough County for use within the Tampa Theatre;
7providing that the license may be used for special events
8only; providing for payment of the license fee by the
9council; providing for sale of beverages for consumption
10within the theatre; prohibiting sales for consumption off
11the premises; providing that purchasers may remove
12partially consumed, open containers from the premises;
13providing for temporary transfer of the license; providing
14an effective date.

16Be It Enacted by the Legislature of the State of Florida:

18     Section 1.  Notwithstanding any other provision of law, the
19Division of Alcoholic Beverages and Tobacco of the Florida
20Department of Business and Professional Regulation is
21authorized, upon application, to issue an alcoholic beverage
22license in accordance with section 561.17, Florida Statutes, to
23the Arts Council of Hillsborough County, hereinafter referred to
24as "the council," an independent district in Hillsborough County
25located at 1000 N. Ashley Street, Suite 105, Tampa, for use by
26the council within the building known as the Tampa Theatre,
27hereinafter referred to as "the theatre," located at 711 North
28Franklin Street, Tampa. The council shall pay the applicable
29license fee provided in section 565.02, Florida Statutes. The
30license may be used for special events only.
31     Section 2.  Alcoholic beverages may be sold by the licensee
32for consumption within the theatre. The license issued pursuant
33to this act shall not permit the sale of alcoholic beverages in
34sealed containers for consumption outside the building. Nothing
35in this act shall prevent a purchaser of such alcoholic
36beverages from removing an opened, partially consumed container
37of alcoholic beverages from the premises of the theatre.
38     Section 3.  The council may transfer the license from time
39to time to qualified applicants who are either authorized by or
40under contract with the council to provide food services at the
41theatre. Upon termination of a transferee's authorization or
42contract, the license automatically reverts by operation of law
43to the council.
44     Section 4.  This act shall take effect upon becoming a law.
