6 | An act relating to Hillsborough County; authorizing the |
7 | Division of Alcoholic Beverages and Tobacco of the Florida |
8 | Department of Business and Professional Regulation to |
9 | issue an alcoholic beverage license to the Arts Council of |
10 | Hillsborough County for use within the Tampa Theatre; |
11 | providing that the license may be used for special events |
12 | only; providing for payment of the license fee by the |
13 | council; providing for sale of beverages for consumption |
14 | within the theatre; prohibiting sales for consumption off |
15 | the premises; providing that purchasers may remove |
16 | partially consumed, open containers from the premises; |
17 | providing for temporary transfer of the license; providing |
18 | an effective date. |

20 | Be It Enacted by the Legislature of the State of Florida: |

22 | Section 1. Notwithstanding any other provision of law, the |
23 | Division of Alcoholic Beverages and Tobacco of the Florida |
24 | Department of Business and Professional Regulation is |
25 | authorized, upon application, to issue an alcoholic beverage |
26 | license in accordance with section 561.17, Florida Statutes, to |
27 | the Arts Council of Hillsborough County, hereinafter referred to |
28 | as "the council," an independent district in Hillsborough County |
29 | located at 1000 N. Ashley Street, Suite 105, Tampa, for use by |
30 | the council within the building known as the Tampa Theatre, |
31 | hereinafter referred to as "the theatre," located at 711 North |
32 | Franklin Street, Tampa. The council shall pay the applicable |
33 | license fee provided in section 565.02, Florida Statutes. The |
34 | license may be used for special events only. |
35 | Section 2. Alcoholic beverages may be sold by the licensee |
36 | for consumption within the theatre. The license issued pursuant |
37 | to this act shall not permit the sale of alcoholic beverages in |
38 | sealed containers for consumption outside the building. Nothing |
39 | in this act shall prevent a purchaser of such alcoholic |
40 | beverages from removing an opened, partially consumed container |
41 | of alcoholic beverages from the premises of the theatre. |
42 | Section 3. The license may be transferred from time to |
43 | time to qualified applicants who are either authorized by or |
44 | under contract with the council to provide food services at the |
45 | theatre. Upon termination of a transferee's authorization or |
46 | contract, the license automatically reverts by operation of law |
47 | to the council. |
48 | Section 4. This act shall take effect upon becoming a law. |
