6An act relating to Hillsborough County; authorizing the
7Division of Alcoholic Beverages and Tobacco of the Florida
8Department of Business and Professional Regulation to
9issue an alcoholic beverage license to the Arts Council of
10Hillsborough County for use within the Tampa Theatre;
11providing that the license may be used for special events
12only; providing for payment of the license fee by the
13council; providing for sale of beverages for consumption
14within the theatre; prohibiting sales for consumption off
15the premises; providing that purchasers may remove
16partially consumed, open containers from the premises;
17providing for temporary transfer of the license; providing
18an effective date.

20Be It Enacted by the Legislature of the State of Florida:
21
22     Section 1.  Notwithstanding any other provision of law, the
23Division of Alcoholic Beverages and Tobacco of the Florida
24Department of Business and Professional Regulation is
25authorized, upon application, to issue an alcoholic beverage
26license in accordance with section 561.17, Florida Statutes, to
27the Arts Council of Hillsborough County, hereinafter referred to
28as "the council," an independent district in Hillsborough County
29located at 1000 N. Ashley Street, Suite 105, Tampa, for use by
30the council within the building known as the Tampa Theatre,
31hereinafter referred to as "the theatre," located at 711 North
32Franklin Street, Tampa. The council shall pay the applicable
33license fee provided in section 565.02, Florida Statutes. The
34license may be used for special events only.
35     Section 2.  Alcoholic beverages may be sold by the licensee
36for consumption within the theatre. The license issued pursuant
37to this act shall not permit the sale of alcoholic beverages in
38sealed containers for consumption outside the building. Nothing
39in this act shall prevent a purchaser of such alcoholic
40beverages from removing an opened, partially consumed container
41of alcoholic beverages from the premises of the theatre.
42     Section 3.  The license may be transferred from time to
43time to qualified applicants who are either authorized by or
44under contract with the council to provide food services at the
45theatre. Upon termination of a transferee's authorization or
46contract, the license automatically reverts by operation of law
47to the council.
48     Section 4.  This act shall take effect upon becoming a law.
