12  recommended the following amendment:

14         Senate Amendment (with title amendment) 
15         Delete everything after the enacting clause
16  
17  and insert:  
18         Section 1.  Subsections (4), (5), and (6) are added to
19  section 1003.455, Florida Statutes, to read:
20         1003.455  Physical education; assessment.--
21         (4)  By October 1, 2005, each school district shall
22  submit to the Department of Education a copy of the wellness
23  policy required by the Child Nutrition and WIC Reauthorization
24  Act of 2004. The department shall provide for public
25  electronic access to the school district policies so they may
26  be reviewed and shared. School districts are encouraged to
27  regularly solicit public input regarding their policies on
28  school nutritional offerings and physical activity/fitness
29  offerings.
30         (5)  Staff development for physical education
31  instructors must include content related to an integrated

Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. CS for SB 126 Barcode 281548 1 curriculum that supports classroom learning, particularly in 2 the areas of reading and mathematics, fitness-based 3 instruction, and connections between movement and learning. 4 (6) By January 1, 2006, each school board is 5 encouraged to: 6 (a) Assess the level of participation of the students 7 in the school board's physical education program in order to 8 determine whether the school board's policy reflects the local 9 community's expectations and needs. 10 (b) Ensure that certified physical education teachers 11 are hired to teach physical education. 12 (c) Review and determine whether the school board's 13 professional-development opportunities include best practices 14 for fitness-related instruction, strategies that support 15 classroom learning, a connection between movement and 16 learning, and strategies for integrating academic subject 17 matter, particularly in reading, mathematics, and physical 18 education. 19 (d) Review the practice of providing physical-fitness 20 assessments at each grade level in order to provide valid 21 information to students and parents for improving the quality 22 of physical education programs and to determine whether its 23 physical education program is meeting the needs of the 24 community and parents. 25 (e) Review the research and best practices regarding 26 how planned physical movement can foster enhanced learning in 27 academic subjects. 28 (f) Review the adopted school board's physical 29 education policies in order to ensure that the policies meet 30 the intent and spirit of the law, applicable rules, and the 31 Sunshine State Standards. 2 12:28 PM 04/11/05 s0126c1c-ea22-t9q

By September 2006, the Department of 2 Education and the Department of Health shall coordinate a 3 series of regional meetings that bring together various 4 stakeholders to develop partnerships, discuss issues, provide 5 workshops, and showcase exemplary programs relating to 6 physical education and fine arts for students in 7 prekindergarten through grade 12. Participants in the regional 8 meetings should include school-level and district-level 9 personnel; county and municipal parks and recreation 10 personnel; parent-teachers associations; and other interested 11 parties. 12 Section 3. Each public high school that has athletic 13 facilities or participates in interscholastic sports shall 14 have an operational defibrillator on the high school grounds. 15 Section 4. The Department of Education shall evaluate 16 the extent to which the Sunshine State Standards in the arts 17 are being taught in each school district in kindergarten 18 through grade 12. The evaluation shall include an analysis of 19 student FCAT achievement levels compared to Sunshine State 20 Standards arts instruction and enrollment in art courses. The 21 results of this evaluation shall be provided to the Governor, 22 the Speaker of the House of Representatives, and the President 23 of the Senate by March 1, 2006. 24 Section 5.
