1 A bill to be entitled
2 An act relating to public K-12 educational
3 instruction; creating s. 1003.456, F.S.;
4 providing legislative intent with respect to
5 maintaining elective programs in the performing
6 and fine arts; requiring each district school
7 board to develop a performing and fine arts
8 program; requiring that the school boards adopt
9 written policies for providing time and access
10 to the performing and fine arts for students in
11 prekindergarten through grade 12 and provide a
12 copy to the Department of Education by a
13 specified date; requiring reports to the
14 department; requiring each district school
15 board to appoint a performing and fine arts
16 coordinator to implement performing and fine
17 arts programs developed by the school board;
18 amending s. 1003.455, F.S.; requiring each
19 district school board to appoint a physical
20 education coordinator to implement physical
21 education programs developed by the school
22 board; providing an effective date.

24 WHEREAS, the education of children in this state shall
25 be a fully developed curriculum, allowing students' time and
26 access to a wide variety of curriculum choices, and
27 WHEREAS, the curriculum for students in Florida is
28 defined by the Sunshine State Standards, and
29 WHEREAS, American culture is significantly taught
30 through the performing and fine arts, and

1 WHEREAS, classes in the performing and fine arts have
2 an effect on the academic success of students in
3 prekindergarten through grade 12, as well as on the individual
4 achievement of students, and
5 WHEREAS, the arts are designated as part of the core
6 curriculum in the federal "No Child Left Behind Act," NOW,
7 THEREFORE,

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 1003.456, Florida Statutes, is
12 created to read:
13 1003.456 Performing and fine arts;
14 assessment.--Recognizing the importance of maintaining a
15 balanced, well-rounded curriculum for students in this state,
16 the contributions of the performing and fine arts, and other
17 elective programs to the academic success of students, it is
18 the intent of the Legislature to ensure that elective programs
19 remain strong and accessible during the school day.
20 (1) Each district school board shall develop a
21 performing and fine arts program that addresses this state's
22 rich cultural diversity and promotes creative thinking and
23 problem-solving skills of students. Each student shall be
24 allowed sufficient time and access to instruction in order to
25 acquire knowledge and skills in the performing and fine arts,
26 which shall be defined by and assessed against the Sunshine
27 State Standards.
28 (2) Each district school board shall adopt written
29 policies for providing time and access to the performing and
30 fine arts for prekindergarten through grade 12 and shall

1 provide a copy of the policies to the Department of Education
2 by January 1, 2006.
3 (3) Each district school board shall provide an annual
4 report to the Department of Education on trends and student
5 achievement in the performing and fine arts for
6 prekindergarten through grade 12 and the department shall
7 summarize and disseminate the reports to each school district.
8 (4) Each district school board shall, no later than
9 August 1, 2006, appoint from current staff a performing and
10 fine arts coordinator to implement any policy for performing
11 and fine arts developed and implemented by the district school
12 board.
13 Section 2. Subsection (4) is added to section
14 1003.455, Florida Statutes, to read:
15 1003.455 Physical education; assessment.--
16 (4) Each district school board shall, no later than
17 August 1, 2005, appoint from current staff a physical
18 education coordinator to implement any physical education
19 program developed by the district school board resulting from
20 the physical education assessment completed according to this
21 section.
22 Section 3. This act shall take effect July 1, 2005.

1 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
2 Senate Bill 126

4 This committee substitute requires each district school board
to do the following:
5
Develop a performing and fine arts program that meets the
6 Sunshine State Standards;
7 Establish written policies that provide sufficient time
to students in the performing and fine arts from
8 prekindergarten through grade 12;
9 Appoint, prior to August 1, 2006, a performing and fine
arts coordinator, who is a member of the district's
10 current staff; and
11 Report to the Department of Education on student
achievement in the performing and fine arts.

Additionally, the committee substitute requires each district
13 school board, prior to August 1, 2005, to appoint from current
staff a physical education coordinator.
