1 A bill to be entitled
2 An act relating to education; amending s.
3 1003.455, F.S.; requiring each school district
4 to submit a copy of its wellness policy to the
5 Department of Education; requiring the
6 department to post each policy on its website;
7 encouraging each school district to review its
8 level of participation and evaluate the success
9 of its wellness programs; encouraging school
10 districts to solicit public input regarding
11 their policies on nutritional offerings and
12 wellness plans; requiring the department to
13 evaluate the extent to which certain standards
14 in the arts are being taught in each school
15 district; providing requirements for the
16 evaluation; requiring results of such
17 evaluation to be reported to the Governor and
18 the Legislature; requiring certain public high
19 schools to have a defibrillator on the school
20 grounds; encouraging public and private
21 partnerships to cover the costs associated with
22 the defibrillator; encouraging school boards to
23 review research with regard to how physical
24 movement can enhance learning in academic
25 subjects; requiring certain content to be
26 included in staff development of physical
27 education and arts instructors; providing an
28 effective date.

30 Be It Enacted by the Legislature of the State of Florida:

1 Section 1. Subsections (4), (5), and (6) are added to
2 section 1003.455, Florida Statutes, to read:
3 1003.455 Physical education; assessment.--
4 (4) By September 1, 2006, each school district shall
5 submit to the Department of Education a copy of the wellness
6 policy required by the Child Nutrition and WIC Reauthorization
7 Act of 2004. The department shall post the policies on the
8 department website so that they may be reviewed and shared.
9 (5) By January 1, 2006, each school district is
10 encouraged to review the level of participation and evaluate
11 the success of the wellness programs throughout the district
12 in each school setting.
13 (6) School districts are encouraged to regularly
14 solicit public input regarding their policies on school
15 nutritional offerings and wellness plans to ensure that the
16 policies meet the intent and spirit of the law, applicable
17 rules, and Sunshine State Standards and reflect the local
18 community's expectations and needs.
19 Section 2. The Department of Education shall evaluate
20 the extent to which the Sunshine State Standards in the arts
21 are being taught in each school district in kindergarten
22 through grade 12. The evaluation shall include an analysis of
23 student FCAT achievement levels compared to Sunshine State
24 Standards arts instruction and enrollment in art courses. The
25 results of this evaluation shall be provided to the Governor,
26 the President of the Senate, and the Speaker of the House of
27 Representatives by December 1, 2005.
28 Section 3. Each public high school that has athletic
29 facilities or participates in interscholastic sports shall
30 have an operational defibrillator on the high school grounds.
31 Public and private partnerships are encouraged to cover the

1 cost associated with purchase, placement, and training on the
2 use of the defibrillator.
3 Section 4. Staff Development.--School boards are
4 encouraged to review the research and best practices regarding
5 how planned physical movement can foster enhanced learning in
6 academic subjects. Staff development for physical education
7 instructors and arts instructors must include content related
8 to an integrated curriculum, particularly in the areas of
9 reading, mathematics, arts, fitness-based instruction, and the
10 connection between movement and learning.
11 Section 5. This act shall take effect upon becoming a
12 law.

14 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

17 The committee substitute deletes the requirements for district
school boards to develop a performing and fine arts program,
18 establish related policies, and appoint a performing and fine
arts coordinator and a physical education coordinator.

The committee substitute requires each school district to
20 submit to the Department of Education a copy of the wellness
policy required by the federal Child Nutrition and WIC
21 Reauthorization Act of 2004.
22 The committee substitute encourages school districts to
evaluate the success of wellness programs and the level of
23 participation in each school setting; solicit public input on
school nutritional offerings and wellness plans; and review
24 the research and best practices on how planned physical
movement can foster enhanced learning in academic subjects.

The Department of Education must meet requirements, including
26 posting school district wellness policies on the DOE's
website, evaluating the extent to which the Sunshine State
27 Standards in the arts are being taught, and providing the
evaluation results to the Legislature and the Governor.

The committee substitute also requires an operational
29 defibrillator on the grounds of each public high school that
has athletic facilities or that participates in
30 interscholastic sports, and staff development for instructors
in physical education and the arts.
