1	A bill to be entitled
2	An act relating to motor vehicle and motorcycle insurance;
3	creating s. 627.7289, F.S.; requiring certain insurance
4	policies to provide coverage for towing and impoundment
5	costs relating to recovery of stolen vehicles; prohibiting
6	application of a deductible to coverage of certain costs;
7	requiring the Office of Insurance Regulation of the
8	Financial Services Commission to enforce the provisions of
9	the section; providing an effective date.

11	Be It Enacted by the Legislature of the State of Florida:

13	Section 1.  Section 627.7289, Florida Statutes, is created
14	to read:
15	627.7289  Required comprehensive coverage; deductible not
16	to apply to motor vehicle or motorcycle towing or impoundment
17	costs.--Any insurer issuing insurance policies in this state
18	covering motor vehicles or motorcycles shall include in the
19	comprehensive coverage provisions of such policies coverage for
20	the costs of towing and impoundment in connection with the
21	recovery of stolen motor vehicles or motorcycles covered under
22	such policies. The deductible provisions of any policy of motor
23	vehicle or motorcycle insurance, delivered or issued in this
24	state by an authorized insurer, providing comprehensive coverage
25	or combined additional coverage shall not apply to coverage for
26	the costs of towing and impoundment in connection with the
27	recovery of stolen motor vehicles or motorcycles covered under
28	such policy. The Office of Insurance Regulation of the Financial
29	Services Commission shall enforce the provisions of this
30	section.
31	Section 2.  This act shall take effect July 1, 2005.
