1 A bill to be entitled
2 An act relating to youth athletics programs;
3 requiring a security background screening by
4 the Department of Law Enforcement for persons
5 who volunteer or work for a youth athletic
6 association; prohibiting a person from
7 volunteering or working with a youth athletic
8 association before completing the screening;
9 providing for the payment of fees to cover the
10 costs of screening; defining the term "youth
11 athletic association"; providing an effective
12 date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Background screening requirements for
17 personnel of a youth athletic association.--
18 (1) Pursuant to chapter 435, Florida Statutes, any
19 person who volunteers or works for a youth athletic
20 association must meet level 2 screening requirements as
21 described in section 435.04, Florida Statutes. A person may
22 satisfy the requirements of this subsection by submitting
23 proof of compliance with the requirements of level 2 screening
24 conducted within 6 months before the date that person
25 initially volunteers or works for the youth athletic
26 association.
27 (2) A person may not volunteer or work for a youth
28 athletic association prior to the completion of level 2
29 screening.
30 (3) Under penalty of perjury, each person who
31 volunteers or works for a youth athletic association must

1 agree to inform the youth athletic association immediately if
2 convicted of any disqualifying offense while volunteering or
3 working for the youth athletic association.
4 (4) A person who applies to volunteer or work for a
5 youth athletic association shall pay the fees associated with
6 obtaining the required level 2 screening. Payment for the
7 screening shall be submitted to the youth athletic
8 association. The association shall establish a schedule of
9 fees to cover the costs of level 2 screening. The Department
10 of Law Enforcement shall charge a rate sufficient to cover the
11 costs of such screening pursuant to section 943.053(3),
12 Florida Statutes.
13 (5) As used in this section, the term: "youth athletic
14 association" or "association" means any organization that acts
15 as an organizing, sanctioning, sponsoring, scheduling, or
16 rulemaking body for municipal or county athletic events in
17 which minors participate. The term does not include a school
18 athletic association or the Florida High School Athletic
19 Association.
20 Section 2. This act shall take effect July 1, 2005.
