  1                      A bill to be entitled

  2         An act relating to labor pools; amending s.

  3         448.24, F.S.; authorizing a labor pool to

  4         provide day laborers with a method of obtaining

  5         cash from a cash-dispensing machine; providing

  6         criteria for the use of a cash-dispensing

  7         machine; providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (7) is added to section 448.24,

12  Florida Statutes, to read:

13         448.24  Duties and rights.--

14         (7)  Nothing in this act precludes the labor pool from

15  providing a day laborer with a method of obtaining cash from a

16  cash-dispensing machine that is located on the premises of the

17  labor pool and is operated by the labor pool or by an

18  affiliate pursuant to chapter 560, if required, for a fee for

19  each transaction which may not exceed $1.99, provided:

20         (a)  The labor pool offers payment in compliance with

21  the provisions of paragraph (2)(a) in the form of commonly

22  accepted negotiable instruments that are payable in cash, on

23  demand at a financial institution, and without discount;

24         (b)  The day laborer voluntarily elects to accept

25  payment in cash after disclosure of the fee; and

26         (c)  The cash-dispensing machine requires affirmative

27  action by the day laborer with respect to imposition of the

28  fee and allows the day laborer to negate the transaction in

29  lieu of payment in compliance with paragraph (2)(a).

30         Section 2.  This act shall take effect July 1, 2005.

                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 1288

 3                                 

 4  This committee substitute differs from SB 1288 in the
    following manner:
 5  
    --   Limits the per transaction fee at $1.99, rather than $1;
 6       and

 7  --   Requires the labor pool or the affiliate operating the
         cash dispensing machine to be registered as a money
 8       transmitter, if required.
