18 and insert:
19 ARTICLE VII
20 FINANCE AND TAXATION
21 SECTION 19. VOTER APPROVAL REQUIRED FOR PROFESSIONAL
22 SPORTS FACILITIES.--
23 (a) No revenue of the state or any county, school
24 district, municipality, special district, or agency thereof
25 shall ever be taken from the public treasury directly or
26 indirectly in aid of any professional sports team, or to pay
27 for any facility used or intended to be used by any
28 professional sports team or for any professional sporting
29 event, unless approved by a vote of the electors of the state
30 or by the electors of the affected county, school district,
31 municipality, or special district. However, this section does

1 not prohibit the payment of funds for such purposes if such
2 payment was authorized before February 1, 2005.
3 (b) This section does not apply to agreements or
4 obligations that the legislative body of the governmental
5 issuer or obligor finds are entered into or incurred pursuant
6 to a finance plan to refund or restructure debt issued or
7 obligations originally incurred or authorized prior to
8 February 1, 2005, if such a plan is in the best financial
9 interests of the citizens of the governmental unit, and such
10 plan is expected to achieve an aggregate net savings of
11 revenue needed in the future for such purposes from the public
12 treasury.
13 BE IF FURTHER RESOLVED that the following statement be
14 placed on the ballot:
15 CONSTITUTIONAL AMENDMENT
16 ARTICLE VII, SECTION 19
17 VOTER APPROVAL REQUIRED FOR PUBLIC MONEYS TO BE USED IN
18 SUPPORT OF A PROFESSIONAL SPORTS TEAM, SPORTS FACILITY, OR
19 SPORTING EVENT.--Proposing an amendment to the State
20 Constitution to prohibit the use of public funds to aid,
21 directly or indirectly, any professional sports team, or to
22 pay for any facility used or intended to be used by any
23 professional sports team or for any professional sporting
24 event, unless approved by a vote of the electors of the state
25 or by the electors of the affected county, school district,
26 municipality, or special district, to exempt any such payment
27 of funds which was authorized before February 1, 2005, and to
28 exempt certain agreements or obligations entered into after
29 such date, relating to the restructuring or refunding of debt
30 or obligations entered into prior to that date.
