  1                      A bill to be entitled

  2         An act relating to public K-12 educational

  3         instruction; creating s. 1003.4205, F.S.;

  4         providing a popular name; providing legislative

  5         intent; requiring the provision of instruction

  6         regarding sun safety and skin protection;

  7         providing requirements for such instruction;

  8         providing an effective date.

  9  

10         WHEREAS, melanoma is the most common cancer in young

11  adults aged 25 to 29 and the leading cancer killer of women

12  aged 30 to 35, and

13         WHEREAS, sunburn during childhood and intense

14  intermittent unprotected sun exposure increases the risk of

15  melanoma and other skin cancers, and

16         WHEREAS, the American Cancer Society found that less

17  than one-third of children aged 11 to 18 use any form of sun

18  protection, and

19         WHEREAS, almost three-quarters of youth report getting

20  sunburned during summer months, more than one-third of whom

21  used a sunscreen, and

22         WHEREAS, over 95,000 new cases of melanoma are

23  estimated for 2004, with melanoma-based deaths occurring at

24  the rate of one per hour, and

25         WHEREAS, Florida has the second highest incidence of

26  melanoma in the nation, and

27         WHEREAS, melanoma claimed the life of Cynthia M. Disman

28  at the age of 30, leaving behind a bereft husband and two

29  preschool-aged sons, NOW, THEREFORE,

31  Be It Enacted by the Legislature of the State of Florida:

 1         Section 1.  Section 1003.4205, Florida Statutes, is

 2  created to read:

 3         1003.4205  Required instruction in sun safety and skin

 4  protection.--

 5         (1)  This section may be cited as the "Cynthia Disman

 6  Melanoma Prevention Act."

 7         (2)  The Legislature recognizes that most melanomas are

 8  preventable. It further recognizes the correlation between

 9  childhood sun exposure and the development of melanomas in

10  adults. It is the intent of the Legislature to ensure that

11  children are educated about the preventable causes of melanoma

12  and actions that students may take to protect themselves.

13         (3)(a)  Each district school board shall make provision

14  for instruction regarding sun safety and skin protection

15  within the district school board's student progression plan.

16  Such instruction shall be offered at the elementary, middle,

17  and secondary school levels. The instruction may be offered

18  within health, science, comprehensive health education, life

19  management skills, or physical education courses. The

20  instruction may be conveyed to students in print or

21  electronically.

22         (b)  Instruction regarding sun safety and skin

23  protection shall include, but not be limited to, risk factors

24  for melanoma, sources of ultraviolet rays, and measures to

25  prevent skin cancer. Measures to prevent skin cancer shall

26  include, but not be limited to, avoiding sun exposure during

27  certain daylight hours and wearing appropriate clothing,

28  including hats, to protect the skin from sun exposure.

29  Specific instruction shall be provided regarding the proper

30  application of sunscreen and intervals at which sunscreen must

31  be reapplied to maintain skin protection.

 1         Section 2.  This act shall take effect upon becoming a

 2  law.
