  1                      A bill to be entitled

  2         An act relating to traffic safety; creating the

  3         "School Crossing Guard Protection Law";

  4         amending s. 316.072, F.S.; providing penalties

  5         for willfully failing or refusing to comply

  6         with a lawful order or direction of a school

  7         crossing guard; providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  This act may be cited as the "School

12  Crossing Guard Protection Law."

13         Section 2.  Subsection (3) of section 316.072, Florida

14  Statutes, is amended to read:

15         316.072  Obedience to and effect of traffic laws.--

16         (3)  OBEDIENCE TO LAWFUL ORDERS AND DIRECTIONS OF

17  POLICE AND FIRE DEPARTMENT OFFICIALS.--It is unlawful and a

18  misdemeanor of the second degree, punishable as provided in s.

19  775.082 or s. 775.083, for any person willfully to fail or

20  refuse to comply with any lawful order or direction of any law

21  enforcement officer, traffic crash investigation officer as

22  described in s. 316.640, traffic infraction enforcement

23  officer as described in s. 316.640, school crossing guard as

24  described in s. 316.75, or member of the fire department at

25  the scene of a fire, rescue operation, or other emergency.

26  Notwithstanding the provisions of this subsection, certified

27  emergency medical technicians or paramedics may respond to the

28  scene of emergencies and may provide emergency medical

29  treatment on the scene and provide transport of patients in

30  the performance of their duties for an emergency medical

 1  services provider licensed under chapter 401 and in accordance

 2  with any local emergency medical response protocols.

 3         Section 3.  This act shall take effect October 1, 2005.
